I already have the case awaiting a hearing after an allocation order, which I have complied with, however the banks in house solicitors have writen stating that as it was a commercial account the unfair terms in consumer contract regulations 1999 do not apply to business accounts.

 

They have however made an offer of a goodwill payment of £1820 this is against a claim for just over £4000.

 

Oh and because I had a business loan with them which is now with debt collectors they will only repay to me the courts costs the balance goes into the debt collectors. You notice Business loan but down to me personally but they can twist themselves around the regulations to suit themselves.

 

Do I roll over, or my inclination is to push on, but I really cannot aford to loose

suggestions please! but not on a fag packet :confused:

Hello and welcome to CAG.

 

You can't use the UTCCR 1999 for Business claims. You have to rely on Common law. There is a link here to give you some guidance on what to do. Have a good read around the forums under your banks name. Which bank is it?

You should still push on and ask for the remainder of the charges. Business accounts can claim the statutory interest under s.69 County Courts Act in the same way personal accounts can. The is not added to the claim until you enter a claim within the courts.
