You have every chance of eradicating most of it - I have;) I was paying 2k a month to my creditors till the you know what hit the fan. They will not call round - they do not have the right. Hard to take in at the moment - I know - but really you have to take control here and you have the power to do it. In a month or two you will be helping other people with the experience you have gained from sorting out your own situation

I sincerely hope so. I don't see an end - I see a solution immediately but I want it to be over but I suppose it took time to build the debts it'll take time to get rid of them.

Well once you have sent the CCA letters and they have not supplied you with the agreements you can stop paying them (12+2 working days then a further 30). OK if they find the agreements in the future they can enforce them again but that is kind of unlikely.

 

This is the beginning of the rest of your life. It will not take as long as you think.

I broke the credit agreement by not paying does that make a difference? I've broken the agreement in that case then haven't I? I didn't make regular payments on this particular account and haven't done since 2006

No it makes no difference at all. Particularly if they can't prove the debt anyway. We are all human - if we could pay we would.

take a breath Lou! As Goldlady mentioned you have some expert people advising you, I woud suggest starting an individual thread for each Debt though. This will help in giving specific advice on each debt and the means to challenge it, etc.

 

And don't worry even if a creditor can legally enforce the debt you only have to pay what you can afford for unsecured loans. I have people I'm advising who have debts larger than yours and are paying £1 per month coz it's all they can afford

Well thank you even for piece of mind. It was the HFO people that have done this. I will take steps now.

first step is saying you will take the first step! :D lol

 

If you have debts with diffent creditors / dca's dedicate an individual thread to each of them. PM the thread details and I'll keep an eye on them for you. Sooner you do it the sooner you'll get your finances back under control and trust me, this is a great feeling! Your life goes off hold

I tried to negotiate with them and they wouldn't let me. All the people I've had trouble with are the ones demanding more than I can afford or a breakdown of outgoings which I don't HAVE to provide by law do I?

Hiya Lou....

 

The CCA request needs to go to whoever is pursuing you for payment. In most cases, DCAs are the most aggressive and push the hardest.... however, the older the account, the less chance that an Agreement will be found.

 

If you are taking on the lot, then make sure you know which rec. delivery slip applies to which CCA....

Look, I don't want to lecture you here, but you are making a bad mistake by not informing and talking to your parents about your problems. I know it is hard, and scary, but if you are living with them there is very little doubt that they already know something is up and almost certainly believe you are lying to them.

 

by taking them into your confidence you will be able to explain your plan, show them the legislation, point them to your threads & etc. if you come in with a plan, and are able to explain it, then they will be very relieved and supportive.

 

the truth is, whatever you do (short of bankruptcy) your parents WILL be affected. there will be DCA's sending letters to your house / telephoning etc (even if you ask them not to:) ) the DCA may even send an agent around.

tomterm is right, he pretty much always is! At the end of the day the decision is completely up to you but do keep in mind once you start challenging these people, particularly DCA's you will get dozens on dozens of letters thrown at you! Not to mention phone calls as well! There are ways of stoping the calls but in the initial interim period there will be a lot of calls. All I'm saying is at some point your parents will notice something is up.

 

Whether you tell em or not, none of my business, just keep in mind they will see the signs!

Actually for me it was the opposite. We got loads of grief from the DCAs until we sent the CCA letters, and of course the telephone harassment letter, and my favourite letter of all about only the postman and people looking for directions having a licence to knock at the door:D. The postman certainly didn't stagger up the path with a pile of valid CCAs, that's for sure. God knows what the poor guy thought when things were really bad - one day he HANDED me a card from a DCA saying 'we called today but you were out' :confused: - fell flat on their faces with that one.

 

My Dad would have been the same if he was still alive - he never had a debt in his life.

I already get hundreds of letters begging me for payment so I suppose they'll just increase!

 

I give out my mobile number not my home number so I can monitor the calls.

 

I'm just praying that doing the CCA thing will help because I read a thread earlier and my debt is after 2004 so I bet they will have the CCAs.

 

I still can't afford £50 a month to HFO with everything else I am paying at the moment.

Remember not only do they have to have copies of the Original, but they must contain all prescribed terms, in all the cases i've dealt with not one creditor so far has produced a legally enforcable agreement! Beggars belief doesn't it!

I am positive or trying to be! I know there's success stories but my debt is PURE overspending and I've learnt the hard way!

 

What I did was send all my CCA requests out on the same day, that way the timescales coincided and was easy to keep track. It does keep you fairly busy though!
