  1. Had a note from Royal Mail regarding and item of mail that had unpaid postage by sender .and RM wanted £2 for unpaid postage to deliver. My suspicions were raised as the note used almost my full name, so I sat on it until the 18 day deadline for the item to RTS Had to visit the delivery office this morning to collect a couple of other items , and the postie allowed me sight of the letter awaiting me to shell out £2 for delivery. Surprise Surprise the letter bares all the hallmarks of being from a PPC , window envelope , no return address on the back ,my full name as if lifted from DVLA and the appearance of a printed form .And I do have a slight suspicion of where it might refer to , I was working in and outlet centre and might have strayed over the limit of 5 hrs . So I left RM to RTS , I have the drop card regarding unpaid postage , so am able to keep a time line . Let the fun begin
  2. Hi Guys..My first post and i need some advice please... I've attained judgement, elevated to High Court and entered agreement with The Sheriffs. The HCEO called at the LTD companies address to collect payment, although i instructed them to go to the actual place where the work was/is carried out and where i have viewed lots of assets. They then called at the "asset address" some two weeks late, giving the defendant plenty of time to move/relocate/hide/change ownership of the assets. Not much of a surprise that there were no assets at the second address.... Where should i go from here ?? and are the HCEO at fault ?? and why cant i speak to the agents, only an office clerk...
  3. Hi there, newbie here! I would be so grateful if I could get some advice and help on this. I've been reading so much on this awesome forum that my head is starting to spin. There's definitely loads to get through. Without further ado, I received a claim form with issue date 12 May 2015. Solicitors are Bryan Carter and claimant is Lowell. It's for a capital one credit card I took out pre 2006. To my knowledge, this debt is statute barred as I have not communicated with Lowell in recent times. I did find a letter that I drafted to Lowell some time in 2010; however, I am not sure I sent it to them as I have no trace of making any payments to them. Name of the Claimant ? Lowell portfolio Date of issue – 12th May 2015. I have calculated my timeline as thus - Issue date - 12/05/2015 + 5 days of service - 16/05/15 + 14 days to ack - 30/05/15 + 14 days to submit defence - 13/05/15. Hope I'm right. - 4pm Friday 12th june-dx What is the claim for – The Claimants claim is for the Sum of £848.03 being monies due from the defendant to the claimant under an agreement regulated by the consumer credit Act 1974 between the defendant and Capital One under account reference XXXXX and assigned to the claimant on 15/09/2006, notice of which has been given to the defendant. The defendant failed to maintain the contractual repayment under the terms of the agreement and a default notice has been served which has not been complied with. And the claimant claims £848.03 The claimant also includes statutory interest pursuant to S.69 of the county acts 1984 at a rate of 8.00% per annum from the date of assignment of the agreement to date but not limited to a maximum of one year and a maximum of 1000 amounting to £67.85 What is the value of the claim? £915.88 + £60 Court Fee and £70 Sol's costs Is the claim for a current account (Overdraft) or credit/loan account or mobile phone account? Credit card When did you enter into the original agreement before or after 2007? Before Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim. lowells Were you aware the account had been assigned – did you receive a Notice of Assignment? I think so but it was a long time ago Did you receive a Default Notice from the original creditor? Yes Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? not sure, not in the last 4 to 5 years definitely Why did you cease payments? Lost my job and could not keep up with payments What was the date of your last payment? Not sure at all, definitely pre 2010 but I no longer have access to the bank account I was using pre 2010 Was there a dispute with the original creditor that remains unresolved? No I am looking to acknowledge via MCOL before the week runs out and I have prepared my statute barred defence as thus: 1 The Claimant's claim was issued on 12/05/2015 2 The Claimant contends that the Claimant's claim so issued is a claim in contract and is statute barred pursuant to the provisions of section 5 of the limitation act 1980. If, which is denied, the claimant contends that the Defendant is in breach of the alleged contract, in excess of 6 years have elapsed since the date on which any cause of action for breach accrued for the benefit of the Claimant. 3 The Claimant's claim to be entitled to payment of £915.88 or any other sum, or relief of any kind is denied. Is this ok? Do I need to send both CCA and CPR 31.14 requests to Bryan Carter or will the CPR 31.14 request alone suffice? Thanks so much in advance!
  4. Hey guys, recently the shop I work at has had a few issues and I'm hoping to know where I (and a couple others) stand with things. Looking through my paperwork re; issues recently I can't find a copy of my contract. I also do not remember if I ever signed one (I may or may not have). Iirc they have 3 months from me starting to issue me a copy (if I did sign one). If I DIDNT sign one, under what terms am I actually working if anything came to a head? On the above note, several times recently in conversation it's come up that 'staff must be flexible' regarding their hours and that it's stated in our contracts. Without having my contract to hand I've no way of telling if this is true, nor whether there's any stated definition of flexible. Would there be anything that would be standard for this definition?
  5. Hi I've just received a text from Newlyns saying they will attend tomorrow to remove goods. I also accidentally deleted the text!!! so can't remember the exact words a nd don't have the mobile number it came from. I remember it said to call 'this number' now. This debt is a liability order from Canterbury Magistrates for non payment of council tax. I own a small flat near there which is way too small for my family and which I'm trying to sell. I've never lived in it. Council have charged me a full year's tax with no rebate - which I will need to look into as it's 25% rebate most other places for single occupant (or no occupant?). I have been unemployed for nearly two years and now have a job. But Newlyns demanded I pay the £1200 over 6 months even though I was unemployed when I spoke to them. Having been unemployed for so long it's really crippling me trying to catch up with all my unpaid bills now, to the point where I have nothing left each month within a week of pay day. Sometimes I have to cancel a standing order. I didn't pay Newlyn in November and I didn't pay them in January. I'm just too broke. I'm facing a huge council tax bill where I'm living now which will probably need to be paid by April, which is £1100 and I'm hoping my daughter will have her housing benefit sorted by then so they will reduce the bill. I don't know how to deal with Newlyns. I've read some of the sticks about bailiff actions etc but I think this firm are really hard. I think it's disgusting that a bailiff company can be successful enough to be a PLC in this day and age. I'm scared. Does anyone know what I should do? I have never had them visit my current address or discuss any belongings with them. I know they asked for my NI number when I originally spoke to them. They said it was to check I wasn't working. thanks
  6. Hi all, It's a while since I've been on, but your advice in the ast has been excellent so thank you. Today I received a claim form from NorthamptonCCBC, Claimant - Lowell/BW Legal. It says that I owe £451.19 but it does not say what its for or who its from so I'm rather confused! I have had debts in the past but obviously if I don't know what it's for how can I be expected to pay it, Don't get me wrong, If I owe it then I'll pay it but I have absolutely no idea what it's for! Please see attached photos of the form and thank you in advance for any help
  7. Looking for a little advice. First post, but this has been playing on my mind for a few days. Story. Got a perm job through an agency. Not a bad number. Job was sold as accountant PLUS review and improvement duties. The team i joined, long standing small team been there for between 15 - 6 years. I am the first new person for all that time. One line manager. One Director. Director wants improvement, that why i was picked, he calls staff meeting to tell everyone. Line manager does not, and states that his way is perfect and i must not attempt to do what employed to do. I am told i must never communicate with Director without first going through Line Manager. 6 weeks into job, friction within the team, expected but sorted. Now fully integrated. 12 week review for probation period, and line manger says that though i am doing the job, and now integrated, never late, always do what i am asked etc he felt that i didnt spent enough time with him. Though he also said that there is never enough time for him to spend with me. 6 weeks previously i asked for objectives so that i can make sure i meet his expectations, he refused. Bottom line. My line manager if very competitive, feels like he is never to be questioned etc. He finds me a threat, as the Director wanted me to improve the existing processes, on paper i am higher qualified etc, but i am always keen to learn. I feel that he wants me removed as he doesnt like the competition. The conflict stems from the Director and line manager, i am just stuck in the middle. I have started looking for another job. I will continue to remain fully functional in the organisation. I will not question, and will always do what is requested. He may change his mind and keep me on. Either way i cant stay and will make efforts to move as i am clearly not wanted by the line manager, i accept that. So here's my question. I have no legal rights. I know, i looked into it. Should i "formally" raise my concerns to the Director now, or wait until i am told they wont keep me on? Should i just shut it and suck it up? Should i "formally" complain after being told to go? I dont think the Director knows the line managers stance regarding the review, and i have my concerns about the line managers approach to many things including HR management and professionally. Once asked to leave, i have little reason to carry this on, but professionally i feel that the company is suffering because of the line managers approach. This is in direct conflict of the shareholders requirements. Any ideas?
  8. Hi-I'm considering trying to reclaim some or all of my bailiff charges over unpaid (late) council tax. Can anyone please point me to any legislation or regulations that determine valid levies please? I'm confused as to why any walking possession agreement inside a house requires a signature yet it seems that levied goods outside the house are OK if not signed (ie a car or items from a shed/outbuilding) Who decides if a levy requires a signature or not? I'm pretty confident that I can claim my Head H fee back after reading the thread on here. I also have a removal of goods fee of £240 which seems a bit steep. All money has been paid,no goods were removed and no debt is outstanding but as the dust is settling,I feel as though I've been mugged. Any advice will be greatly appreciated
