  5. you can reclaim overdraft charges, if they relate as a penalty for breaching your terms and conditions, so if its going over your o/d limit or using your card when you shouldnt, or having a cheque bounce, they can all be reclaimed, except obviously for using a cash machine , you cant claim that back
  6. well this is the problem. however i must stress that this is only one person, and their circumstances are unusual in that they havent had any communication with their financial institution, and have tried to have a default judgement put in place, therefore the court has had to do some investigating, not only that, but they didnt use BAG standard practice , they heve used the information from another forum , which may have led to this problem, i am only summising, but i am hopefull that as most of our cases never even get to the court allocation stage, we should be allright
  7. it is a tough one is this, i have filed my mcol about 8 days ago, so i really have my fingers crossed that if the cases are all to be stayed, then i just miss that, how much difference is there between the 90% and the 100%? in your claim?

  10. worst case scenario, is you lose £30 -£100 and they close your account, thats about it really, however you would only lose money if you actually went to court and lost, something that no-one has yet

  18. 1). Can I claim for charges applied to my acoount due to 'card misuse'? yes you can, they are typically £10 2). Can I claim for overdraft fees (in my case, of the four times in 6 yrs I have been charged OD fees, I have been charged £25 OD Fee and £75 Excess OD Fee, both fees applied to my account on the SAME DAY!!! If I am overdrawn, I don't understand why they must charge me twice although I'm begining to realise that it's all part of their money making [problem] ....) yes, again you can, and they charge you because (they think) they can 3). WHAT ARE 'TOTAL CHARGES'? I appear to have been charged 'total charges' on several occassions IN ADDITION to the individual charges applied to my account in the same month. Can I claim back total charges as well?? total charges refers to them having a set fee for you going over your o/d but its a daily fee and as they charge per day , they add it all up and slap it on at the end of the month hence "total charges", not to be mixed up with the one off fees like card misuse, d-d return etc, hope thats cleared it up for you
  19. as above, however i think that you may be getting mixed up a little with those people that have asked the bank to produce for them a list of charges only, which when checked against statements didnt tally up ;-)

  22. despite all the fancy wording , all they are saying is that it does actually cost them that much to put "fees" onto your account, however the oft think otherwise that is still the basis of their defence, irrespective of whether you signed an agreement, it is still against common law, this is probably their last stalling tactic to get you to quit, dont give up
  23. that is absolutely staggering :o , i'm fairly sure that they cant do this (surely not). however if this is the case, then not only should we not let them treat people in this way, then as bf says, its important that you post this information in the halifax foum so that other people can make alternative arrangements before commencing action i know that hsbc have shut some accounts down, but they have given people 30 days notice first
  24. yes you will have to inform the bank of your new address, or they wont be able to send you any correspondance, is the account closed?, if so you will have to prove who you are by photocopying driving licence etc and send a cover letter with your dpa saying that you've moved house
