tnook replied to tnook's topic in Financial Legal Issues
I've had a look on the site for templates to use as my POC for the credit card claim. Are these still current? -
Santander - Going to court please help with POC

Ok I've downloaded the Charges spreadsheet and plugged in all my charges from 2002 till now. The charges are either £25 for the earlier one and £12 later on. There were 29 charges in total. I calculate the claim to be £541 for the charges, plus £478.44 interest they have taken on the charges (it was an eye opener). Totaling £1019.44. -

Santander - Going to court please help with POC

Ok keen to get this going Is my joint case too complex? Should I split it into two cases then? Credit Card charges then Current Account? I was hoping to leverage the credit card charges as unfair debt. Can I still do this if the cases are separate? -
Santander - Going to court please help with POC

The FOS said no and said they would not pursue it further. It was slightly over the 6 months reply period because I delayed and tried to mix the CC & Current account. The only route now is County Court. -

Hi thanks for the feedback. The POC on here was an early attempt at joining existing POCs for Credit Card Charges and Current account charges on this site. I linked the two because I want to drive the point that covering their excessive credit card charges put me in further debt with my overdraft. So I won't just be relying on POC for the current account. Wasn't aware that you had to start the claim online now, I checked last month and the courts website gave me two options, first online, second via the post. I am under pressure to get this in motion as the bank are threatening to Default me over the current account charges. -

Much appreciated. I've made some changes since my earlier draft above. Shall I email the current POC to you? Thanks. -

Hi, I started one here a while back. But haven't updated it. http://www.consumeractiongroup.co.uk/forum/showthread.php?382883-Going-to-court-please-help-with-POC

Hope it works out for you. I just sent off my N1 form today challenging my bank under BCOBS too. Good luck.

Interesting I had a small business account with Barclays and was hammered with overdraft fees, can I try to claim these via BCOBS?

Santander - Going to court please help with POC

This is as far as I got with the POC, any help would be greatly appreciated: -
Hi everyone, Santander are getting nasty regarding my overdraft which I have been disputing for a while and threatening to default me. I am drafting a POC which combines my Credit Card and Current Account charges. The approach I am using is that my excessive Santander Credit Card charges, which I paid, lead me into debt where I had to rely on my Santander overdraft, the charges on the overdraft are a result of the cycle of debt and also unfair in general (BCOBS). Can someone have a look at my POC and let me know what they think? I need to get this sent off to the courts asap to keep the collections department at bay. Thanks. tnook

BCOB apply to Business Accounts too?

FOS has after long delay said they won't look at the case as I missed the 6 month window. Pity it took them so long. Now its back to the original plan of taking this matter to the County Court. I've sent off a letter before action and will start working on my POC. The outline is: 1. Unfair Cahoot credit card charges and interest kept building up 2. These caused me to slip further into overdraft on my current account with Cahoot. 3. Cahoot then started applying further charges to the current account. Trying to link the two account and the Credit card charges as the initiator ih my POC. Also the current account charges happened in 2009 so might be able to apply BCOB.

Hi, My charges case is still stayed with the county court from the OFT days. Can I update my POC with the latest approach on using the BCOB unfairness rules? Thanks for any insights. Tnook

I have a business account with Barclays and they have applied many charges over the last 5 years for going over the overdraft limit etc. Was wondering if the BCOB unfair treatment rules would also apply to business accounts? Does anyone have any insight into this approach?

HFC (HSBC) stalling payout - want certified signature

Does anyone know how long it takes HFC to pay up once you accept their offer? -
HFC (HSBC) stalling payout - want certified signature
tnook replied to tnook's topic in Payment Protection Insurance (PPI)
HFC have caved in and are agreeing to pay back all PPI payments plus 8% on my most recent loan. However the one that is 4 years old and they claim not to be able to find the paperwork on they are not refunding. HFC admit there was PPI on the account however. I have a list of all the Direct Debits made to them back then, does anyone think I have a chance of carrying on the claim with the ombudsman? Don't have the agreement unfortunately. -

Wow after 11 weeks HFC finally respond with a PPI questionnaire! Should I just go straight to the FOS now? Anyone had any experience in filling out the questionnaire? -
