Yes it was a credit against my current balance. They refunded me slightly less because they calculated based on the contractual rates at the time of each charge. The contractual rate has varied over the years. Will definately make a donation asap this site has been invaluable. Sending off SAR for pre 6 year charges. It's for two cards I had with them but no longer have the account numbers. No doubt they will use this against me. I provided address details for the accounts.

Another "We are still looking into your complaint" letter from Cahoot/Santander in response to my LBA. Sigh.

Got their standard reply ie "we think the charges are fair etc". Sent my LBA today.

Just wondering if I should be claiming contractual interest on the credit card charges. Does anyone have any experience of doing this with Cahoot?

Developing them based on the content I've been researching along with my "individual" case. Reluctant to post anything on here at the moment because the solicitors might be watching. Simmons & Simmons said they would consider my amended POC once I sent it to them. I imagine they will object to them, is there a way I can press them through?

Wow that was quick I just had a letter back from some solicitors (Simmons & Simmons) claiming to be defending Barclays. Has this happened to anyone else?

Just posted a letter to Barclays, used the template from Martins MSE site, asking if they don't mind me changing my POC and also offering them another chance to settle. I don't expect I'll hear anything back.

Just starting the process of reclaiming credit card charges against Cahoot. Preliminary letter sent off. Anyone know how stubborn they are? Will they chase it all the way to court?

Afraid I don't have any statements prior to 2005. But thats ok. I'll focus on the last 6 years. I was amazed at the difference adding compounded contractual interest made to the total claim. Almost doubled the figure compared to charges and statutory interest. I don't mind giving it a go, already in court with Barclays (stayed) so I know the court route. Just not sure if it goes to court will the judge throw out the claim if its based on contractual interest?

Hi Martin, Sorry no thread, I was quietly getting on with it. The charges are all £12 for the past 12 months. MBNA caved in when I sent in my LBA.

Hi, Just to spur you all on, today I got a letter from MBNA refunding all my charges and interest on charges (£400) in full following my Letter Before Action.

Hi all, My case is one of the many stayed during the OFT test case. Recently I also got the letter from Barclays claiming victory and that County Court Cases would be dealt with. I'd like to get my stay lifted and proceed before they get the case struck off. I've managed to pick out my POC, will these need amending? 1. The Claimant has an account XXXXXXXX with the Defendant. 2. Since XX/XX/XX the Defendant debited charges and interest in respect of purported breaches of contract. 3. Defendant is aware of all details as a list of charges has already been supplied. Another copy will be sent. 4. Claimant contends: (a) The charges exceed the Defendant's losses caused by the breaches; (b) The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law. 5. Claimant claims: (a) return of the amounts debited of £XXXX; (b) Interest per S.69 County Courts Act 1984 of 8% - £XXX continuing at 8% until judgment or settlement at a daily rate of £X.XX; 6. Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. 7. Costs allowed by the Court. Thanks, tnook

Hi just a quick question. I am about to send a preliminary letter to claim back charges from a credit card company. I got statements from them going back to 2002. Should I ask for charges from back then to be included? Just thinking because its beyond the 6 year limit. Also are people having luck getting the £12 charges refunded? Thanks for your help.

Four more phone calls from Barclays. They admit they will call constantly and relentlessly. I need to make that complaint to the FSA. What will they actually do though?
