  1. I just got a letter from Barclays Solicitors. They say that the letter above is goodwill and if I don’t accept the offer they will file a defence and pursue me for costs. GOGW letter £125.pdf Interesting that the solicitor says the data will be with me shortly and yet Barclays restated in their letter they don’t have it.....

  4. Ugh I need that data. I know there are a significant amount of charges there. I had asked them previously for the data and they said that they no longer had the account numbers, but if I did supply the account numbers they could access the data on microfiche. I gave up as I didn't have the account numbers. Then last year in my GDPR request the account numbers were all there on their client summary sheet..... they had them all along.
  5. It's odd in that I would have expected a letter from the Barclays legal team, not the Barclaycard Customer Service team. Also the coincidence about the amount £100 (amount I am claiming) plus £25 (the court fee). £100 complaint settlement letter.pdf Looking back over the letter's I have sent to BC customer services. The last letter was the one based around @BankFodder's template requesting a certificate of destruction. They replied that they didn't need to send one. Since then I issued the POC for the SAR. I suspect the legal team have prompted them to expand on their last letter and offer the 'goodwill'.
  6. It's peculiar that the court case is against Barclays, yet this is a letter from the same lady at Barclaycard customer services and it almost reads like a continuation of the complaint. I'll scan it and add it here with the sensitive bits redacted.
  7. Yeah, I was using the template previously used in other successful Barclays SAR cases (eh Shelly). The monetary compensation is not that important to me the key thing is to get them to provide the data which is also requested in the POC.
  8. The aim is to get the old data, if I decline their offer and it goes to court won't it get thrown about because it will look like I am being unreasonable?

  10. Barclays have written to me. I got a letter from Barclaycard offering to pay me £100 goodwill for getting the wording on their last response about GDPR law saying they had to store things for 6 years. They also offered £25 good will for it all taking so long. This is £125 which is the amount I am claiming in the court case. Does this mean they have effectively offered to settle and I need to close the claim?
  11. It’s their right. Defendants can request an additional 14 days to respond.
  12. Update: Barclaycard have requested an additional 14 days to respond to the claim. Have to wait till mid May now.
  13. No worries. Let's see how my court actions pans out. BC have two weeks to reply, they can also request a two weeks extension. I suspect they will automatically lodge a defence and it will go to court. Will see. Feels good though doing something though
  14. Peculiar, how did the other success stories on CAG, like Shelley get their data after going to court or starting court action?

  16. Ok update. I have submitted my claim form using the new online service. Very nice, not limited to 1000-ish characters. Barclays has until the 29th to respond. Naturally they will be late. File a defence and take it to court. I’m a patient man
  17. Thanks Craigten. In my case I suspect the data is on microfiche and they don’t want to look for it. I can’t see them deleting it.

  19. Barclaycard customer services just called me to inform me they have completed their review and their 'privacy department' informs them that they are not obliged to prove destruction of the data and that they will not meet my request. They will send this in writing as a final response.
  20. Have you called them? the key lesson is to stick to your timeline not theirs. They don't care about your timelines and their processes will ignore them. You've sent them the same letter I sent Barclaycard. Time to sue. That gets their attention and get them off the 'customer services' process.

  22. I think they have put processes in place to make us give up chasing. We will persist and hopefully win. But along the way many will be too lazy or easily persuaded to give up. But as for the call handlers and customer services, no I don't think they know what's going on.
  23. I'm in the same boat. Follow my thread, about to sue Barclaycard to break the barrier.
