    • I am still working on the WS. I have not been well over the past week I think due to stress. I have drafted some of it but still have a bit to do. I checked MCOL today as nothing received from the court yet. I can see that claim has been transferred to local court. I guess our next deadline will be stipulated by the court rather than the claimant ? When does the chance for mediation happen ? Does the court suggest this ?

    • Hi to all, Thought it may be an idea to update this thread for anyone who is following / in the same situation. Still getting the weekly letters from Moorcroft, Westcot etc. with regards to Tesco, RBS & Natwest - also had the odd letter & email from AIC & OPOS in relation to the same debts........so looks like a few different ones chasing the same debts but still with the OC? Lowell have been considering legal action since Sept '23 with regards to both Paypal accounts but have yet to decide and keep reminding me every month. Not heard anything for ages from anyone with regards to Virgin. The most persistent seem to be PRA Group with regards to the Barclaycard debts.....these have now all been forwarded to Brodies. I've uploaded the 4 letters my partner has received with regards to the 2 Barclaycards she has - she is really worrying about these so posted that some kind member can reassure her again - is there still nothing to do at this point until they actually decide to take it further? I've done some further investigating as I have the original emails from Barclaycard. The actual dates of account opening on the PRA letters are completely wrong..........not even close to when they were opened so the liklihood of them having or obtaining any original paperwork seem slim. Also, not sure this is of any relevance but one of her Barclaycard accounts was originally Egg and taken over by Barclaycard. Another point is that most of the companies chasing have at some point got our address wrong and the mail has gone to our neighbour. We live in a group of 3 houses with the same address but all different house names - I'm assuming that omitting the actual house name from the address is a bit of a no no?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

bought a computer for my daughter 4 days ago from currys/pc world.

It was described as a social computer which means just basic use.

I said thats fine she's only 11 so as long as she can play basic games and watch you tube that's ok.

The assistant said yes.

 

got it home and it was absolutely terrible.

I think it took 6+ hours for all the updates,

not sure exactly on the time but went to bed and left it on overnight.

 

 

The next day my daughter put it on it did even more updates for half an hour and on the left side of the screen a name popped up (something??) whatmann?

I just had a feeling it had been used before (was sealed when bought though).

 

 

she managed to just add a desktop pic and couldn't do anymore because it was that slow.

I decided to take it to my sisters house incase it was down to my Internet running slow, so tried again there.

 

 

We could barely open a page without it freezing, took about 15 mins trying to open 3 tabs and wouldn't close them straight away either also YouTube was buffering so no music either and the front speakers set at 100% played at about 20/30%.

 

Checked reviews later and they were all terrible,

I've looked online about taking it back and people have all put their experiences saying they won't refund as item open and used,

but if I didn't open and try how would we know.

 

 

I really don't want to be stuck with this as it won't be and can't be used, I genuinely think it's faulty.

Does anyone have any advice on my rights with returning it?

If it is faulty, you can return it.

If it was misdescribed (based on facts), you can return it.

Where it gets difficult is if it isn't faulty, and hasn't been misdesecribed / misrepresented, but becomes a matter of opinion as to what a 'basic', 'social' PC should do.

 

Probably the key issue is why it is slow.

 

In theory it meets the minimum spec to run Windows 10

although this only means it could run Windows 10, not will run it at any reasonable speed.....

Needling to do lots of updates : not a reason to return the PC, as any replacement will also need the Windows updates. You need to look at its speed / performance once all relevant updates are done.

 

Youtube buffering? You need to establish if it is the PC that is the issue, or youtube/the internet connection. Again, you can't reliably do this while performing updates....

 

This PC has a AMD E1-7010 Processor, which might be the cause of your woes, if you are placing too much demand on it.

It also only has 4Gb of RAM, which again may be the cause of the woes. If the RAM is fully utilised it may have to use a 'swapfile' in place of RAM, which will lead to data being written to the hard drive all the time. If this is this case you'd heard the hard drive working constantly.

 

Malware might be a problem too, so if all else fails scan it with malwarebytes.

There are many more possibilities, (including running 2 'competing' anti-virus programs that then conflict)

 

So, start Win-doze, and make a cup of tea, natter to your friends, and let it do everything it does until it has completed all its housekeeping.

Then open up "Task manager' (press the windows button, or click the windows icon in the bottom left of the screen).

Go to the "Windows System" part of the menu that appears, and Task manager should be clickable there to start it.

 

Open up one window of your browser, and try an play one video from youtube.

Task manager should give you an indication of CPU and memory usage on its default "processes" page, but next to the processes tab is a 'performance' tab that will let you look at CPU usage, memory usage and more.

 

Down the bottom of the 'performance' page there is a clickable link to "open resource monitor" : if need be you might be asked to look here for further details.

 

Post back with some indication of if there is something clearly making it slow, or some resource that seems 100% utilised much of the time.

within 30 days if faulty

and you should be given a full refund

 

 

I believe the store has a 28 days returns policy anyway

but watchout for their unlawful restocking fee!!

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

That wold only apply to online purchases, not in store purchases.

PC World does have a 28 days return policy, but only on unopened items.

I've never heard of PC World/Currys charging a restocking fee though.
