      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

eeek help. when issuing N1 forms to sue do i issue to "barclays bank plc t/a the woolwich" or just"the woolwich ltd." help!

OK quick question...

 

I have two addresses for the woolwich - from the woolwich website i get

The Woolwich

Watling Street,

Bexleyheath,

Kent DA6 7RR

as the head office address.

 

But on that link it has the Churchill Place, London address (Barclays Head Office) so which is the one I should use for the court claim?

Can I just add here - I served my papers on the Woolwich at their Churchill Place addy - and they have written to the court saying this is the wrong address and the court has given them an extra month to reply!!!

 

I think this is realy another scary or delaying tactic on their behalf but I thought I would post here to let others know!

Cheers Allyxia - ironically I served them at their Watling Street address, then wrote a letter to the same address to let them know of the court action. They replied to my letter saying that all correspondence should be through Barclays Head Office Customer care....

i was with the woolwich,...but on my claim i put barclays and the london addy....as they were corresponding with me as opposed to the woolwich.

 

this is getting alot of people into a mess coz of woolwich/barclays :eek:

Quick question, I have sent a claim for payment in 7 days to my local branch,

 

I have been offered good will gestures from Barclays in london,

 

Should I now phone Barclays in london and leave a message (as I cant seem to talk to anyone) and tell them that I sent a claim letter to woolwich, (who have not replied)?, the 7 days ends monday

I have had a woolwich open plan account for years which is a cash withdrawal only. I went overdrawn because of charges last year whichaccumulated to over £500. I paid money in to the account to cover these and more but have received a letter from them this week saying they have written off my overdrwn balance (which i didn't know i had) and are closing my account 10 days from the letter. Can I put in a claim to refund the charges if they close the account?

 

I only have 3 days left before they close it!

I would definately claim the costs back that they applied to your account. The costs they applied to your account were unlawful and you paid them. This is your money. If you have all the details make a claim today, if not send a letter requesting all costs applied to your account. Good Luck

help I have to put court docs in asap as case is on the 6th july. i have dl'd the cag pack but id there a letter format i should use as a covering doc or standard claim letter? I am currently in deepest Ireland which is not helping me out! thanks Kajun...up against those nice folk at the woolwich/barclays......

Apologies if this has been pointed out previously, however using Web Archive Org, I looked up an old Woolwich site Welcome to The Woolwich which states catergorically that the Barclays change over won't change Woolwich cheque books or cards - as we all know, Barclays have removed old Woolie items and everyone now has Barclay accounts with B cheque books and cards!"Will my branch and contact centre numbers change? No. Please continue to contact your branch and contact centre in the normal way. It is business as usual. ""Will I keep my Woolwich cheque book, cheque guarantee cards etc? Yes."Hhmmm :)

They're winding down the Bexleyheath office. I live close by and an old client was looking to buy the site in the last year, it's no where near as busy as it used to be but don't have anything confirmed.

During the barclays take-over of woolwich I made what would appear to be a successfull claim for my bank charges I even got awarded judgement but what with the take over process barclays claim to know nothing about it. I'd be gratefull far any advice here.
