    • Hopefully by mid July my credit file should be cleansed. They have said it takes 56 days or they have 56 days. That should be the end of it. I asked if I could have an apology and be compensated. I got a 'we are sorry for the inconvenience' and all we can offer is a £20 voucher to use on studio. I said thanks but I'd rather boil my eyes in acid than shop with you. I wasn't expecting them to compensate anyway, I just thought I'd ask. I just want my credit file sorted, my account closed so I can put this mess to bed. Thanks for the help, hand hold and encouragement, it has been very much appreciated.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

If the DCA were to try and take you to Court they would have to present the Original Document. Now you know they do not appear to have it so you can challenge them to take you to Court with the documentation they have produced so far. You can point out to them that the informationregarding rates etc contained in the crap they sent you does not correspond with what you remember signing. You can admit signing something without actually saying you have a copy of the original.

its my sig ok taken from another doc and inserted into a copy of an orig which it is not as i have a copy of original agreement sent to me by them with different dates on.and my sig is completely different from orig and from copy

the copy of orig is but might not be under the figures side of things had this checked on the loans agreement checker but i dont think i will put my trust in this as its a £150 fee for a true check.

It really doesnt matter who the creditor is. We have a clear cut case of FRAUD here. I would try to get the Creditor to make a writteb admission that this is a copy of the original document and then I would destroy them through the COURTS and the MEDIA

 

The bigger the organisation involved the better.

if they have put another sig from a differnt doc into the orig copy agreement then this is fraud do you have an original copy of your agreement to prove this if you have get some legal advice from someone in town or from a cag member i personaly would consult a solicitor half hr free advice or maybe a trip to your local police staion for a chat with a fraud prevention officer.

I dont claim to be an expert and nor does my partner but we have both looked at those signature and we both say that they are not the same as the bottom one is not spaced out the same and the D, at least that is what i think it is, is different to.

 

Just a thought but have you tried measuring the length of the signature and the length and height of every letter. I only ask because on CSI they were doing a piece which involved a possible fraud and measured the signature of a letter which they new the victim signed and then one of the signature which they thought was fake. I know this is not how it may be done in reality but it is worth a try.

 

I think this is a case of fruad that needs reporting.

hi all,

 

have a real problem here sent cca to creditor which they supplied a copy of agreement with different dates and have copied and pasted my sig from another document cheque/application dont know which but the strange thing with this is i have a copy of cca agreement the sig and dates are different from the orig.also no terms and conditions which are on reverse side of orig copy

 

should the copy be exactly that a true copy of original it has all prerscibed terms but the sig on the copy is not the one i signed on the original doc so although its my sig they have definitely taken it from another doc is this fraud? £20K LOAN

 

any help would be most welcom. i havent a clue how to persue this for the best as this could get very messy for me as they can afford the best barristers in town unlike my little self.:)

Yes there has been sum ppl that say they have heard of it or seen documents that are obviously fraud but i can say i have not yet come across any type of fraudlant activity yet.

 

Please dont think that i am saying it is not possible as i do think they will try anything to get your money which they may or may not be intutled to under the law.

 

If i come across anything i will let you know.
