    • Oh, one other thing. It may sound a silly question, but as they say - silly questions are better than silly mistakes. The correspondence address in the current case and the previous one is correct and current. I've never actually written to the banks to confirm my address, as is regularly advised, because I presumed if Moriarty/IDR/J&P are using that address, there would be no need to. So because both cases seem to have my address correct, should I still write to the bank or take it that there's no need in this instance?

    • Hi all Just coming back to this Forum, as it helped me so much a few years back with ADCB/Moriarty. So I've had the circulars from IDR chasing Emirates NBD debt. They've been on and off over past few years, seem to be a run of letters, emails SMS and then go quiet, then start again.   A few months ago, same started with J&P, just a basic letter, email, sms asking to get in contact. Then last week I saw an email from Emirates NBD saying J&P were acting on their behalf. Up to this point, the main thrust of the letter seems to be please contact us, or contact ENBD about payment. Then I received a letter - I can't scan/upload it at this time but I will as soon as I can - which appears to be similar to what I've seen on other threads. Namely giving bank details of ENBD, saying they've been "instructed to pursue action", and saying they've enclosed a copy of Information Sheet, Reply Form in compliance of Pre-Action Protocol They state I have 30 days from date on letter to reply, and "if you fail to do so our client may have no option but to pursue further action against you". I'm of the view, as per advice on other threads and my experience with the other lender/company, to reply as per thread #5 in the main thread. On the basis that I wouldn't wish to give them ammunition by not replying or missing the opportunity. I'm aware that on some threads, in similar situation, one poster had been advised by sols not to reply and apparently J&P didn't progress from there, other than sending same requests. I feel these things are always down to the individual's choice, and I'm keen to see what others may have done/may be doing so will actively read other threads also.   Please feel free to ask if I can help with anything, or share any opinions, and in the meantime I'll get the uploads done ASAP.   Thanks again for everyone's help in the past, and hopefully the future, and good luck to all

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have requested SAR details for Barclays Bank and it is now well over 40 days since I sent this request and today I have not received it. I have written to them to remind them that it is over 40 days since I requested details that hold on my and copied my letter ICO.

 

Is there a penalty for delaying in sending out SAR to people.

I have written to them to remind them that it is over 40 days since I requested details that hold on my and copied my letter Information Commissioners Office.

 

Is there a penalty for delaying in sending out SAR to people.

Penalty? You can complain if you want..The IC can add it to the list.

You can claim damages under the Data Protection Act - I've just done this with O2, as they are now 120+ days in to a S.A.R - (Subject Access Request) period and haven't responded.

 

Ironically, they've sent me a cheque this morning for £130.00 (I won in Judgment by Default) - but they STILL haven't complied with the SAR yet! I'm considering suing again if they don't comply in the next 2 weeks, for the same amount, then doing it again and again and again until they get the point! :rolleyes:

I have written to the post office to see if my postal has been cashed got to wait until I hear back from them first before I can do anything. The Post office address is: Postal Order Correspondence, Method of Payment Team 1,

Ground Floor East, future Walk, Chesterfield, S49 1PF. I sent them the letter lase week as well as to Barclays and copied the same to ICO. I will give it till the weekend as it will be well over 50 days since I sent the SAR to Barclays.:?

I went into my local post office and took the receipt of the £10.00 that I had cross and made out to Barclary and I was given the above address to write to them to find out if the postal order had been cashed. :-|

Well, I was surprised to received a reply today from Royal Mail, as it is only 7 days ago since I wrote to them about my PO of £10.00 to Barclays for S.A.R.

The post office has told me in witting that my PO has not been cashed and if it is not cashed within 28 days from the date of my letter then I will get a refund, also they said that they will inform if it is cashed within the next 28 days.

 

I want to find out what Barclays have on me, which I think now is nothing. I really want to get at Equifax who is still updating an entry from Barclays.

 

If I presented another postal order and give it to my local barclays bank ( I do not have an account with them) would that be regarded them receiving my request.

 

Later on to day I will ring the number on the Royal mails letter to find out if I do this will my original PO if it should be presented for cashing will still be refunded. I am sure it will not but there is no harm in asking.:|

Have you got proof of postage/receipt of your request? Not cashing the PO and denying it's receipt is standard process.

 

If you have, complain to the Information Commissioners Office or start some enforcement proceedings to get them to comply. (Or do both!)

 

You should only be sending another request if you haven't got proof that you sent the original.

unfortunately I did not send my request by recorded delivery, that is why I want my next letter to get to them as asap, by handing it into a Barclays bank hand delivery. I think I will to the bank and asked them if I can do that for clarity.

 

It pays to get a receipt of postage as you cannot trust anyone nowadays.:mad:

You can take it to the branch, but it will be quicker (if that's possible) to send it to the Data Controller address directly, recorded delivery. You'll get the address from the ICO's website;

Proof of postage is important, proof of delivery not so much so, in these cases.

Been to the bank this morning and was told that I could indeed take to them and they would send it off for me but they do not have receipts that they let me have to say that I took it into them by hand. Therefore their is not proof of me taking it into the bank for them to send off the Data control branch. I could indeed take it the address itself but again I would need proof that I left it with them. Also the branch told me that when the PO was received by the bank it would have been cashed straight away.

 

I cannot believe it, now you have to send everything by recorded delivery for a signature and even then you do not always get that.

 

Dose anyone know if it is it 40 working days or is it 40 days inclusive of weekend and bank holidays that they have to reply to my S.A.R. request. :|

You don't need a signature on delivery to prove it was received, as Civil Procedure Rules don't require it - have a read of this thread to see the discussion on this;

The DPA SAR prescribed period is 40 days from the date of receipt. It's an request under the Freedom of Information Act that is in working days, but isn't relevant here.

thanks for that car, however, on a telephone call to the ICO they told me that it is 40 calenders days.

 

As a signature is not important of proof of postage does it mean that I only need to get proof that I sent the letter ie receipt from the post off when I post the letter.:-|

Phoned the Royal Mail and they have informed me that if the PO is not cashed within the next 25 days they will automatic refund my £10.00 which is set up electronically. These B*****s at the bank hopefully do not put the PO within the next 10 days as I will have to send another PO because I do not want to wait for another 25 days before I know what they have on me.

 

I am wondering if when I send the S.A.R tomorrow I will put a paragraph stating that this is the second request as the first one was not received by them and asked them not to cash the PO if they have it in their possession.;)
