    • Their FAQs state - Cancellations and modifications If your booking has been cancelled, Booking.com refunds you immediately. The processing time may take 7 to 10 days and depends on your bank. If you have questions, contact your bank directly. I'm a regular Booking.com and AirBnB user.  The former have never cancelled.  The latter have and my money was refunded immediately (not that that helps you as we're not talking about AirBnB!) Best to check with your bank and see (a) if you did pay in advance and (b) if it has been refunded. Also, have you received a message from Booking.com officially stating the cancellation?

    • You question timescales a bit in thread - From my experience, defaulting everything and ignoring all non PAP letters, while making no payments: - 18 months to LOC - further 18 months to be at court Most are still silent 3 years in though!. If making token payments, court, if ever would be 4-5-6 years from now - Hope that helps. My debt is similar, I started it 2021 and wouldn't believe I'm already over half way through default period. You need to make the decisions but follow advice already given in this thread, and you will be fine. Best time to plant a tree was yesterday, second best time is today. Good luck BT

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Afternoon All,

 

I have been meaning to claim some fees back for a while, starting with MBNA but have not had the time. I've now finally got round to it and have gathered a bunch of forms and letter templates from an article on the BBc news website. However, I had found the article was dated around 2006 and having been mildly aware of some Banks/Credit companies becoming stronger at repelling people like us in the last few months I thought I better check on an active forum if there were any up-to-date or indeed better forms and letters I could use to attack MBNA.

 

I am pleased however to see that it looks like people are still getting money back well into 2007, particularly from MBNA.

 

The stage I am at, is that I have dug out what I think is all my MBNA Mastercard statements for as long as I have had the card, I need to sort through them, put them in order, and then want to go about the process of going through them.

 

What I am unclear on is what I can get back? Can it be missed payment charges and over limit charges? or just one of them, and seems as its a credit card, how does interest affect the final figure i sdhould be entitled to?!

 

Anyone with any help and guidance on this would be much appreciated!

Hi Ryan - welcome to the madhouse :D

 

You can claim back all charges - over the limit, unpaid direct debit/cheque, breathed too quickly - claim it all! I worked out the interest month by month and charged whatever they were charging at the time they applied the fees.

Anyone know how best to calculate that interest on a month to month basis. I'm suprised some computer buff user of this forum hasnt created some sort of whizzy tool we can all use!!!

 

Also then....are the forms on the BBC website still suitable for what I want to do here?

I'm going through my MBNA statements from May2005 to present day at the minute. All O/D and Late charges are £25 up until July 2006 when they change to £12. Does that mean I cant get any of those after July 2006 back!? :???:

 

Also will they only give me £13 for each of my £25 charges prior to July 2006?

No, the £12 was the amount that the OFT stated they would take action against CCC if they charged over this figure. You can reclaim these £12 fees as they are not a genuinepre estimate of any loss. This is a standard tactic by CCC offering you the difference. You are entitled to all the cash back.

Befort I forget, I have noticed that a lot of people on here seem to be claiming stuff for accounts that have gone off to debt collectors and all sorts of other stuff! I still have my credit card with MBNA and it has gone back into the black....I just want the money back from them to help pay for my baby thats due next year!!

 

Whats the chances of MBNA going nasty with me over this? I dont want them closing my account and passing it to debt collectors or anything...that would hurt my credit rating!

got £566 worth of charges over a 2 year period, thats without working out what they owe me from interest....the spreadsheets on this forum dont seem to do what i want them to.

 

I was expecting something that allowed you to list the charges, enter the APR or something and it give you a figure, but thats not the case! Anyone know how to do it manually?!

No, it's a list of type of charge , amount and date.

The easiest way is to use the Simple S/S here:

When entering your charges, don’t delete anything first. Just overwrite the existing examples: type of charge, amount and date.

 

The ‘Days Since’ and ‘8% Interest’ columns will be calculated automatically

 

Save it (for use later at court), then delete/hide the last 2 columns (8% bits) and print out as your schedule of charges for the preliminary and LBA letters

You should be aware that they may close your account,,,, these things can happen. With bank accounts we are advised to open a parachute account, just in case. Maybe the same principal would work for you with a credit card?

I think it is Barclaycard that are known for reducing credit limits when the letters start going back and forth reclaiming the charges.

It's not fair obviously, but it could happen......
