bumping question up - this seems like a directions preliminary hearing - i will post a thread on that .

 

What you have to remember that there is no set formula for any of this and this is now completely at the discretion of the judge and how he feels about the banks cases.

 

It may be that 1) he has decided to "stay the case" anyway - so he is just going through the motions

or 2) he is one of the judges who is fed up with the banks and if they do not do what he asks or put in an individual request for stay in the correct manner - he will rule that the case goes ahead.

 

You have some choices here - it is only a 5 minute hearing - but you could go out of interest as you will familarise yourself with the court and the judge and will hear what he has to say - or as you say you need not attend

 

you could send the appeal against the stay - by doing the new "bundle for appeal against stay" and send to the court and Wragges before the hearing - or at least do a letter - use the template here and then add your own personal bits . If you do this and A&L dont send anything he may decide to proceed

 

I would do a search on here for the judges name or the court to see what has happened in other cases there - it might help

 

You have to find out what you should send before hand - dont thinks its full bundle but the thread i post ( when I can find it! ) may help

 

If not keep asking until someone comes along to help

I have noticed that back in March you provided guidance to someone who received a letter from the court similar to mine and from the same judge. http://www.consumeractiongroup.c o....hlight=hay es

 

I was wondering whether you would still take the same stance and actions as suggested 6 months down the line?

 

Any advice would be greatly appreciated as I really am stuck and not sure what to do!

If your not attending then yes, as per the other thread send representations in 5 days prior to the hearing. Also include the stay witness statement within your representations (see templates library)
