    • I lived there with her up until I gave notice. She took over the tenancy in her name. I had a letter from the council and a refund of the council tax for 1 month.    She took on the bills and tenancy and only paid the rent. No utility bills or council tax were paid once she took it over. She will continue to not pay bills in her new house which I'm now having to pay or will have to. I have looked online I believe the police and solicitors are going by the partner law to make me liable.   I have always paid my bills and ensured her half was paid then see how much free money is over.   She spends all her money on payday loans and rubbish then panics about the rent. I usually end up paying it or having to get her a loan.   Stupidly in my name but at the time it was because she was my partner. I even paid to move her and clean and decorate her old house so she got the deposit back. It cost me £3000 due to the mess she always leaves behind.

    • Just use the print option 'print to pdf' which will save a copy of email as pdf document on your device. If you lived at address as partner when the liability was not settled, then it would be Council Tax legislation they would use. This is designed to stop tenants or owners of a property resident in a property not to pay tax due, when the normal bill payee does not pay the liability due. If you want to know the exact legislation wording, suggest you search for it online, as the legislation is available to view online. If you did not live at address as partner at the time, there is no law they could use.

    • Hi all,   Thank you for your advice. Following the recent developments surrounding the appeal route via Starbucks/Euro Garages, I have not pursued this route. Following my original post I have since received a "PARKING CHARGE FINAL REMINDER" but will just proceed to ignore this as is my right to do so. It is helpful to upload this for others to see? As the registered keeper, I am happy that I am not liable for the parking charge as the notice has not been served in accordance with Schedule 4 of POFA: specifically paragraph 9(2)(f) (warning to registered keeper that creditor has the right to recover from the keeper) and paragraph 9(4) (serving notice within 14 days of alleged contravention). I look forward to seeing MET Parking Services in court

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Yes, I must admit that I am, but it should never have got as far as it did, if halibuts had given folk a chance, no-one would be in this predicament, but unfortunately for us poor peeps, the banks are getting stinking rich, lol. But we must all stick together & get back what's rightly ours.

Yes you did read it, he's being an absolute pangel1.gifI don't think, hehehe. We all really do love him to bits, buuuuuuuuuuuut - I'll be very glad when he goes back home, geez his mother never has him these days. Out of the 6 weeks he has from school, she has had him for only 2 of them, & she only sent 3 boxer shorts, 3 t-shirts, 1 pair of jeans 5 pairs of socks & a track suit, she has got no idea; its a very good job we have a few sets of everything here for him lol.

we won't have time to miss him, 'cos we have him every weekend as well. Trouble is his dad's supposed to be looking after him, but as usual it falls on our shoulders, while his dad's gallivanting all over, with his mates, (he's 28, but wishes he was still 16).

But, I can honestly tell you that it will a very big relief when the little terror (sorry errr darling) goes home, even if he'll be back within a few days.

I'm actually going to see them all tomorrow.

 

I should be so lucky !! Can`t get rid of mine, Youngest is at Uni most of the time but is home for hols, he OK. Next one recovering from brain haemorage stays with us 2 nights a week, he is 30 but result of injury he is like teenager, hard work but at least he is still with us, very close to losing him, and the eldest,well I think I will have to get a bloody big stick and chase him away!!

My oldest (daughter) managed to get herself pregnant at 15, her daughter (my granddaughter) is now 14, & trouble is she looks 18 when she has her normal gear on, & to make matters even worse she also stands 5' 7" & still growing. My middle (oldest son) he's 28, but refuses to grow up & work, & my youngest (son) he's 26, he's between jobs, & trying to find out if he's a father to an 18 month old girl. More kids - I'm surrounded by them.

Step-son moved down to Maidstone to live with his mum 10 years ago, but now he's back to be near to his 5 year old thats staying with us. Right I've now gone full circle.

Hi overflow, not too bad, just having a bit of time off from MP thread, & chilling.

Had to get myself a new phone yesterday, 'cos the other one that I dropped in washing up bowl is no good for texts, inside screen is Kn**ke*ed, & I've been told it could cost more than the thing is worth. So my new one has all the same stuff on it, & a bit cheaper.
