What a coincidence! The same day I discovered this site, I also found out that the Abbey have bounced a cheque today for £40 despite the fact that funds of £500 that I paid in 2 days ago will clear tomorrow, meaning I will get charged £35! I have applied on line for back statements, and I am staggered to find that on the statements I do have going back to Sept 2003, they have taken £4139 in charges! Like another member I too had a time when I had to go in branch and take over the counter what they deemed fit for me to have from my salary, and yes because I felt ashamed and at fault i accepted the daylight robbery. Only now that i am almost debt free, I have found the confidence to try and get my money back, so....................watch this space!

Hi, whilst i wait for my back statements, I reckon that the past 6 years my claim will give a total of well over £5000 especially if interest is added, seeing as I know it to be over £4000 just from Sept 2003 to date. So........from what I have read, do I need to keep my claim below £5000 for small claims court if it goes that far?

Just to say had a letter from Bradford cust services, thanking me for my request for old statements. said i will recive shortly as in archives.

Is this the sort of letter you want for your records?

Also, now do i give them 40 days to supply, and failing that do i then claim.?

if the answer to this is in FAQS, I'm sorry

Hi

As I'm not totally used to "forums" it's probably my fault I can't pick up my thred from The bank Action group site. i can log in ok, but thats it, so iv'e decided to post a new thread.

Just to re cap I applied on line for back statemnets at the beginning of March and they wrote to say my request was being dealt with. I got that reply a month ago and have heard nothing since..............so i guess i need to go DPA route now, yes?

Also I have been trying to open another account elsewhere in anticipation of Abbey closing me down, and No One will accept me! My credit history must be in such a mess from years ago, so I think I will have to play things abit conservative with all this..........any ideas? They have had over £4000 in charges off me in the past 3 years, so it may be double when i get the older statements to look at. I can see I may have to accept some sort of payoff rather than take them to court, and run the risk of them closing my account.

Hi, it's worth re-reading the FAQ but if they have ignored your request for statements then you have to go down the formal DPA route.

 

The forums on moneysavingexpert.com are a good place to get help finding a new account.

 

Why settle for less than the full amount? It is your money that they have illegally taken from you. You deserve it back, every penny.

 

If you are worrying about going over the £5000 limit for small claims and opening yourself up to costs then think of ways of splitting into chunks (i.e an account at a time, a year at a time or a type of charge at a time).

You may find with the 2nd claim they might play ball quicker (or they might not!).

 

It is worth finding out exactly what they owe you and decide from there.

Claim for £340 sent 11/04/06

I'm not sure what the total of my claim against Abbey will be, but I'm thinking of submitting a claim for charges deducted in 2006, a claim for 2005, a claim for 2004 etc etc. if it looks like they'll go over £5k. That way, Abbey have to pay 5 lots of court costs too - that'll make them grimmace!

might be better to work oldest first if any are near the six year limit.

Yeah, I guess so. Saying that, I didn't open my Abbey account until around September 2000, so every charge on my account can be claimed back anyway!

DO NOT put the claims in at the same time - sever them, by all means.

 

If you put them in at the same time the bank will apply to the court to have them put together and this could push you into the fast track rather than the small claims track.

 

You are still protected from costs up to a max of £750 - if you lose.

 

I still think you'd win, but to be on the safe side - win one at a time.
