    • I googled "prescribed disability" to see where it is defined for the purposes of S.92. I found HMRC's definition, which included deafness. I don't  think anyone is saying deaf people cant drive, though! digging deeper,  Is it that “prescribed disability” (for the purposes of S.88 and S.92) is defined at: The Motor Vehicles (Driving Licences) Regulations 1999 WWW.LEGISLATION.GOV.UK These Regulations consolidate with amendments the Motor Vehicles (Driving Licences) Regulations 1996...   ….. and sleep apnoea / increased daytime sleepiness is NOT included there directly as a condition but only becomes prescribed under “liability to sudden attacks of disabling giddiness or fainting” (but falling asleep isn't fainting!), so it isn’t defined there as a “prescribed disability”  Yet, under S.92(2)(b) RTA 1988 “ any other disability likely to cause the driving of a vehicle by him in pursuance of a licence to be a source of danger to the public" So (IMHO) sleep apnea / daytime sleepiness MIGHT be a prescribed disability, but only if it causes likelihood of "driving being a source of danger to the public" : which is where meeting / not meeting the medical standard of fitness to drive comes into play?  
    • You can counter a Judges's question on why you didn't respond by pointing out that any company that charges you with stopping at a zebra crossing is likely to be of a criminal mentality and so unlikely to cancel the PCN plus you didn't want to give away any knowledge you had at that time that could allow them to counteract your claim if it went to Court. There are many ways in which you can see off their stupid claim-you will see them in other threads  where our members have been caught by Met at other airports as well as Bristol.  Time and again they take motorists to Court for "NO Stopping" apparently completely forgetting that the have lost doing that because no stopping is prohibitory and cannot form a contract. Yet they keep on issuing PCNs because so many people just pay up . Crazy . You can see what chuckleheads they are when you read their Claim form which is pursuing you as the driver or the keeper. they don't seem to understand that on airport land because of the Bye laws, the keeper is never liable.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hmm thats very bad Lady E its not good to do that to you especially so close to a court date the judge should have made a the bank turn up to argue the stay seeing as it was so close to the court date very bad!

Hi All,

 

I called into Caernarfon County Court this morning, just to check on the progress of my claim. I like to look into people's eyeswhen talking to them. I like to know when people are trying to give me a load of bull, something I can't do when talking on the phone. Anyway, I have been told that ALL cases at Caernarfon County Court are being transferred to Cardiff and that All cases have been stayed. I will receive written confirmation of this fact within a couple of days. So it seems that Caernarfon County Court are staying all cases. Once I receive confirmation I will post it's contents here. I thought it was all too good to be true, LOL !!!!!!!!!!!!!.:mad:

Hi All, I have received from HULL COUNTY COURT today a reply to my judgement request informing me it is stayed due to there currently being a 'test case' due. I can wait :mad:

03-06-2007--Prelim sent.

It would be very useful if you could post what your local court has told you regarding stay on claims due to the OFT report. We dont need to know what the banks said, we all know they will just tell us that they have a stay and that is that.

Remember that if your claim is involving a credit card claim, then it should NOT be stayed, and if it is you should appeal this decision immediatly.

Halifax 2 N1 submitted 20/07/07 stayed 24/08/07 N244 Application filed 31/08/07 hearing set for 12/11/07 rescheduled for 29/01/2008. Application dismissed stay still in place.

Charity Group £200 compo for lost passport.

HM revenue & Customs; demand for WTC overpayment £632.12. Disputed, their error. Did not have to repay.

Had a letter from Watford County Court today stating : "The court of its own initiative orders that this claim is stayed until 31 March 2008 with a view to awaiting the decision of the test case. Either party may apply at any time, by application onnotice in accordance with CPR 23, to lift the stay. If no such application is made, the court will give directions of its own initiative on the expiry of the stay."

just spoken to Aldershot & Farnham county court and they have recieved all my CB for my case next tuesday.... but the good news is they have not recieved nothing from abbey... their cut off date was 21st august...the lady at thye court said the case will go ahead and it is unlikely now i will have it stayed... abbey could try to have it stayed on the day but due to them not filling the CB it will most likely not be granted.... YIPEEEEEEEEEEE!!!!!!!!! now what do i do on the day... i have printed off the paperwork incase they try to have it stayed but what do i do with regards to them not filling the CB... do i try to get abbey struck out and if so what do i need to do??? So in short Aldershot court is still have claims heard and is based on case to case situations......

Banbridge court in Northern Ireland has just sent me a letter which I received today (court date on Monday) to say that the District Judge has directed that all bank cases be stayed until the end of February 2008 due to a test case pending in England. No need for attendance at court on Monday. Notification will issue in due course of your Court date for February/March 2008!!!!

Ginger Rogers could do all Fred Astaire did but SHE could do it backwards AND on heels!

Don't get too complaceant? That happened to my hubby. Abbey didn't submit anything. I rang the court (Newcastle upon Tyne) the day before and they told me that Abbey had applied for a blanket stay on all claims but the judge would not allow it and said that Abbey would have to apply on an individual basis. They sent a barrister to represent them on the morning of the hearing and he was applying for a stay. When we entered the room the judge had been given instructions that morning to stay all bank charge cases until the High Court test case goes through.

 

My hearing is due for 28 September and I have just rang the court and they told me it is still going ahead for that date and probably the smae thing will happen.

Sorry to burst your bubble adam1976brown but in nearly all cases Abbey have not submitted a CB but have been allowed to turn up on the day and apply for a stay and have been granted it. So polish up your arguements against a stay application you will most likely need it

Just got back from court this morning for my bank charges claim. Abbey again sent a barrister to apply for a stay.

 

The judge was lovely. She told the barrister that she couldn't find any papers in regards to the application for the stay and he said that he was here now to make the application. She told him that it wasn't good enough and he explained that because of the volume of these cases banks left it till the last minute.

 

She said that in that case she was awarding me costs for my time and gave me the maximum £50!

 

She stayed the case though pending the outcome of the test case as she said it wouldn't be fair to rule now. I thought she was going to at first!

Funny how they manage to do it at the last minute! If they can do it at the last minute they must know in advance but do not see it as important.

just an update.

Rang Skipton County Court tonight to see if they were still carrying on, and they informed me that ALL cases there are being stayed and they will take new cases but will more than likely stay them at point of application.

will try and clarify what they mean.:confused:

Just an update, Halifax CC have extended their stay on all claims until 28th JULY 2008 until the Judge makes his decision:mad: ,

 

Stay in there guys we've waited this long and I think it's flown, so another 5 months worth of added interest won't go amiss now will it!!!;):D
