      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

The N1 link does exactly the same as the N1 pdf gizmo here - remember you cannot save on either so print off a lot more copies than you will need - just in case.

 

MCOL is really only geared up to - I have a small business, I sent you an invoice, you've not paid it, time to summons you = MCOL then you would normally pay-up before a hearing - well stuff like that.

 

I would still go down to court though, cos it will be a familiarisation visit :)

Hi,

I wondered if anyone has thoughts on the most effective way to submit a new claim I have for NatWide. I am ready to go on Moneyclaim online or a Finanacial Ombubs complaint. I am up to aq on Abbey at present but the fees are affecting the new complaint. It can be a bit pricy doing it all at once.

Hya done 4 claims now and won, my advice is scrap the mcol and do a proper poc, this will save you time later on. do this on a N1 which you can download from hmcs and look up a poc relevant to you on this site.

Can anyone answer my question about stays please?

 

When the bank applies for a stay, will the court automatically grant the stay or will they notify us of the request for the stay before granting, giving us time to submit our request against it.

 

Does anyone know the process?

The Court will write to you if your case is stayed, you should have 21 days then to apply to remove the stay at a cost of £35.00.

 

The bottom line is that, the courts are inundated and everything takes much longer to be sent out, on the other hand, they will try to offload the work load taking the least line of resistance. IMO they will take a broad brush to batches of claims. Hope this helps until a wiser one comes along.

The problem with the Number 10 website IMO is that although they are supposed to filter for it, you end up with several petitions for the same thing, which of course dilutes their effect.

Looks like we are on our own guys.

 

I have PM'd Martin Lewis at MSE with the links and asked if he can ask his people to put the links on their website so that we cover all MP's (he was online at the time), so will let you know if he replies.

I have a £3500 ovedraft with the Halifax and I estimate that they have applied several charges to the tune of £4000 in the last 6 years on my account.

At the moment in view of the test case I am not sure whether to commence a claim action because I am scared them may recall my overdraft which i don't have any money to repay immediately should they decide to do that.

We have a £2200 overdraft and are claiming nearly £2500 back, they havent threatened to close ours down. Not sure if its because we havent had any charges for the past 9mths or whether they are just not threatening to do it anymore. If you do go ahead and they threaten, then complain about their bullyboy tactics.

From what I understand they are NOT allowed to take retalliatory action of that nature, kokoman. If they threaten to do so, inform the FOS.

 

However be careful, as I understand that any overdraft is payable on demand, so they might just try and 'create' an excuse. Again watch yourself and keep the FOS aware.

just heard some disturbing news, apparently someone on the MSE website had a credit card claim stayed today! I though only bank charge claims were being stayed in light of OFT's super case?
