  1. Consumer Credit Agreement - look at some of the other threads like Standings, Wednesdays and Jacksters!! I've not done it myself yet but am beginning to think I should. From what I understand, if they can't provide a 'true copy' of the agreement you signed, along with the terms and conditions at the time, and list of fees etc, then your debt is technically unenforceable. There's loads of threads about it...have a look and see what you make of it, but it might be worth a try.
  2. Have you already sent them a CCA request? If they can't produce that, then it may be worth doing. I'm not sure it would help you unless you've done this bit though. Dizzy
  3. Hey Jackster! How's things? Hmmm, well, I'm a bit behind with both of my claims - they're both at filing the N1 stage, but havent the time or money do it yet. Anyway, have just emailed Customer Advocate Office, gave them 14 days to pay up in full or go to court. Will now sit back and see what happens.....am also considering CCA request just to see what happens.
  4. Hello! What stage are you at? Have you filed a court claim yet? Have you sent them a CCA request? I'm led to believe from reading other members threads that the CCA request puts your account into dispute - and therefore they are not supposed to file anything on record about you until it is resolved and sort of puts the other stuff on hold. I have still not done my N1 - but they have recently paid me a GOGW of £500ish. They rang me last week to say we had to pay 15% of the overall overdraft into the account each month to keep them from stopping it altogether - but could withdraw it the same day again. It just shows we're using it, I think. Don't worry - someone on here will be able to help you, I'm sure. Dizzy

I admit to having done this once, but then my local Asda brought in these 'self -scan and pay' tills - which was great until I got told off for going through it with more than 15 items (which is annoying as I can scan the items faster than a lot of their checkout staff!!) So we've now got '10 items or less' checkouts and '15 items or less' self -scan tills - WHAT NEXT?? Sorry, feel much better for sharing that though.....
  6. We stayed at Looe Bay (nice pubs there) and went to Goonhilly, Flambards (Helston), Eden Project, Seal Sanctuary, Aquarium at Newquay, Poldark Mine. Thats it I think - don't know how many of them are open in the winter though.

  10. You may be right about the GOGW thing Honestknob - I got 2 offers from different banks yesterday. Both still rubbish but nevertheless......
  11. I can feel panic setting in.....:o ANYWAY - Whose to say that the courts won't still keep on awarding refunds to us poor so and so's until the test case proves otherwise? As far as I can see, the OFT hasn't ruled that no more claims will be dealt with at the moment. There has to be something positive in here somewhere....

  13. The OFT Q&A says that it is for the courts to decide on current claims - hopefully they'll do the decent thing and keep on awarding in our favour. Zootscots announcement says to continue as normal if you're claiming from any of the banks listed. I know how you feel though - I nearly passed out when I read it the first time!

  15. Oh Jules! Did you have to go and spoil it? I was feeling almost cheerful this evening ... So now what do we do? The bit I don't quite get is Q.11 on the OFT announcement regarding current claimants - 'It will be for the courts to decide in relation to claims made to them' - does this mean that the courts can still deal with it? Or only if the banks haven't applied for the waiver?. I'm gutted....
  16. No, didn't have his email address but his title is Senior Customer Resolution Manager in the Specialist Banking Team. What does Grace Ballatyne do? Is she more important than Mr Brettell? AND it had a real signature - maybe they think I'm important - I only got a photocopied signature last time! There is an 0800 number on the letter, but I wasn't feeling brave enough.

Had letter from a Mr John Brettell (amongst other Abbey departments- look at my thread, you'll see what I mean ) yesterday offering a 1/4 of what I'm claiming - checked online banking about 10 minutes ago...and have 14 fee refunds on account! Keep checking online banking - every little helps - whose catchphrase is that anyway? God, its not the Abbey's is it? Have you got Cap 1 money yet?
  18. Blimey, the Abbey are out to impress! I only got my letters yesterday and my account has been credited with 14 miscellaneous fee refunds today! Mr Brettell is nothing but true to his word - now here's hoping he'll do the decent thing and cough up the rest of what the Abbey owe!

Hi all, haven't been around much so have loads to catch up on - Mbna have offered GOGW payment of just under 400 pounds (which will be credited back onto card apparently.This is about 1/4 of what they owe. What do I do? I haven't filed N1 yet - do I get hubby to ring them and see if they make better offer (is this even likely?). Do I just send them a 'no,I want it all back letter' - but accept that as part payment? Or do I just file? Thanks, Dizzy x
  21. Hi all, er, no I haven't filed N1 yet. Sort of snowed under with other things, so have to get it done this week. Had 3 nice letters from Abbey yesterday though - One offering me a GOGW payment of about a quarter of what they owe me, one offering me a super-duper loan, and the other advising me that I am 250 over my overdraft, and asking for it back!! Does anyone think it worth me ringing the ever helpful Abbey to see if they'll offer me any more over the phone?
  22. ...and the other thing I meant to ask is - would it benefit me to request the CCA? I don't really understand what that bit is all about - even though I've read about 100 threads about it .
  23. Well, just as I predicted...no phone call . Hubby asked them for the Customer Advocate phone number and was told that they don't have one and could only be emailed, so thanks for that Penny. I take it this number is an office thats open 9-5ish, so will get him to ring them tomorrow. Will keep you posted.
