Good evening

 

Like most of you I am claiming back my bank charges, how liberating !!.

 

I have two accounts with the Bank of Scotland/HBOS.

 

One claim is for £3,000 the other for £6,000. I have sent the letters to the bank stating that if they don't pay up in fourteen days I will take them to court.

 

However I live in Scotland and I understand the maximum small claim is £1,500.

 

I would be very very grateful if anyone could give me some advice on how to proceed.

I dont know the ways for Scotland but just wanted to ak you have you started your own thread.

If you go to the relevant forum for your bank and start one here you will get all the help you need .

 

Quite a few people claiming from there.

26-06-2007--Copy of N1 from Court, issued 21-06-2007. to Halifax, Deemed Served 25-06-2007

Have till 09-07-2007 to file Defence.

05-07-2007--Note that Acknowledgment of Service been Filed on 29-06-2007.

Have 28 days from date of Service to File Defence.

07-07-2007--Offer from Halifax.

09-07-2007--Rejection letter sent to Halifax. Next day delivery.

10-07-2007--Money put in Account:mad:

Dont worry weve all been there

 

Whatever Bank you are claiming from put the name in the search box

When the Forum comes up youwill see a box on the top left hand side saying NEW THREAD.

 

Click on that and then when the box comes up give yourself a title Grant69 v ??????

 

Once youve done that your on your way.Writing on here is called a post so youve already "posted " 2 .

 

Any problems dont hesitate to give us a yell we're all here for you .

 

Some great people on here which you will soon find out for yourself.

 

Your never on your own and dont be afraid to ask questions even if you think they sound daft.

 

Someone posted on here once "Theres no such thing as a daft question, only daft mistakes" and believe me thats so true.

 

 

Read through as many winners posts as you can so you know what to expect and read as much as you can on the F&Q's .

 

When your sick of readin , read some more youll be suprised how much youll learn and pretty soon youll be giving other people advice

Hi there

 

Thanks for taking the time to read this.

 

I have two accounts with the bank of Scotland, one claim is for 3,000 and the other for 6,000.

 

I have just sent off the letter saying that if they don't refund the money I will take them to court.

 

Which court should I take them to ???. I'm a bit confused as I know the scottish small claims court, claim amount is quite small.

 

Any advice ?????

:) Hi Grant, welcome just ask one of the moderators to start a thread for you, (thread; your own message board ) then read up other threads as much as you can, ask questions if need. you will learn quite a lot from reading other peeps stories. I knew nothing when I started out on my first (it seems to me the banks paid up easier then) I won first and second before taking court action and I have just lodged third with County Court. You will find lots of very, very helpful folk on this and there is always some-one online to help at all times. Just stick to it don,t give in and remember it`s your money.

Halifax 2 N1 submitted 20/07/07 stayed 24/08/07 N244 Application filed 31/08/07 hearing set for 12/11/07 rescheduled for 29/01/2008. Application dismissed stay still in place.

Charity Group £200 compo for lost passport.

HM revenue & Customs; demand for WTC overpayment £632.12. Disputed, their error. Did not have to repay.

All opinions expressed are my own and have no legal standing and no connection to CAG

 

All errors/typos etc are not my fault the blame lies with the spelling gremlins

Hello to you all.

 

I have today sent a letter to BOS/HBOS stating that if they do not repay my charges I will take them to court. I reside in Scotland.

 

This is where it gets tricky and I could do with some help !!.

 

I have two accounts I have claimed £6,345 on one account and £3,131 on the other.

 

Has anyone been in a similar position and if so what action did you take ??

 

I am unsure whether to go to the Ombudsman if they reject me, or file several small claims, or get a lawyer and go to court.

 

Please help

Hi Everyone.

 

I have just recieved my final letter of rejection from the bank. I have two accounts I wish to claim on.

 

One claim is for 6,000 the other for 3,500.

 

Fos are no longer taking claims.

 

1) So I believe I now have two options, I have a friend in England whose address I can use on MCOL, but I'm a little unsure about going down this road.

 

2) File my claim at the court nearest to Halifax's head office in Halifax, Stevekenevo has done this and been successful.

 

When I file my claim using either method do I need to do a claim for each account or can I lump them together.

 

Any replies would be greatly appreciated.

IMHO 2 claims. keep them separate. you might also find it less personal hassle not to start them both at same time!.
