  1. Hi John Hope you had a good time on your hols.New Yorks some place eh !. I have two claims in progress with Hull County Court, both seem to be progressing well. Although I have had a very stamdrard letter saying they will apply for a stay. The woman at the court says that the Judges are reviewing stays, on a case by case basis. I chose Hull because they seem to haven taken the peoples side over the last few months. On my first claim I put my home address in Scotland on the N1 form, I got a letter from the court saying that I needed an address in England or wales for service. So I have set an address on Mymail uk( a company who operates a mail forwarding service). That was last week and I have not heard anything from the court yet. My second claim has gone throgh without them asking for an address in England or Wales. All seems a lottery !! Have a look at the last few posts on my thread. Cheers mate

  4. i'd really hammer on about how long it's gone on and their blatant disregard for deadlines, your attempts at resolution, etc. and lump any attempt at a set aside in with their general disregard for all dates, filings, etc

  9. Evening all The struggle continues, well almost. I have today received a letter from Hull court, reads as follows. "this matter was referred to a district judge in 13th September who directed that you must pprovide an address fro service within this jurisdiction, i.e England or Wales. A defence has been filed but cannot proceed until your address is amended". I put my address in Scotland on the N1 form. I live in Scotland but work shifts in England. When I called the court the very helpful lady explained in a kind of wink wink nudge nudge manner, that if I had a " care of" address the case would probably go ahead. She would not and could not commit either way, but I felt that she was guiding me in to put in a "care of" address. I can't use my digs address as I change frequently depending on best deals. I don't want to use my work address for the obvious reasons. I have a friend who may let me use his address, but I don't want to impose on him and I certainly would not want to get him into bother !!. Although this may be my only option. Or I could employ a lawyer. Anyb ideas or suggestions would be greatly appreciated !! I am almost at my wits end.

Good Old Stone Halifax have 14 days to acknowledge service of N1. this runs from date "deemed served" that is on your Notice of Issue attached to copy of N1 returned by Court, If they have they have a further 14 to file defence, If they have not then you can apply for judgement. You will have to check with Court to see if they have, (they have until 4.00 pm on that date) on day 15, if they have acknowledged and have not filed defence by the end of day 28 then again you can ask for judgement, to do this take the bottom part of the Notice of Service and hand it in to court
  11. Evening All Hope your all well. I filed my second claim Hull Kingston last week it was deemed served on the 15th September. I am going to call the court about my first claim which was deemed served on the 26th August. Here we go.
