Hi,

 

I would like to know if there a claim to be made on incidents that occured 10 years ago ?

 

I was about 18/19 at the time and suffered defaults and 3 ccjs through YB and Jeremy Sutcliffe god knows what they amounted to. Where would I get this information and could I make a claim against them ?

Yes you can claim further than 6 yrs ago ,You will need to write to your local branch.( Subject Access Request) under the DPA .I'm currently claiming charges on an account that they closed 2 yrs ago ,then when I have won will then claim further than 6 yrs.same situation as yourself ,Just remember that all there correspondance will come from Scotland ,You will need to keep yours sent to Your local Branch so you dont come under Scotish Law when you make your claim

The only other thing is, I closed that account (or they did) some years ago so I have no revord of the account number. Would this be a problem ?

Hi Guys,

 

I'm new to this forum. Am usually floating around Lloyds but as they have paid up, I am now going to tackle the Yorkshire Bank. :D

 

Anyway, I am just about to send off for my DPA and wondered when it does come back, it will only list charges taken by Yorkshire Bank. What about the charges taken from me by Jeremy Sutcliffe (Their Solicitors) when my account was handed over to them ? Do I need to send a sepertae DPA for them or can these not be claimed ?

What sort of charges were they?

If the solicitor was employed to recover money which was comprised of unlawful charges then you will be able to recover all of this as well.

 

How much are you talking about here?

Well from the letters I did keep, it tots up to a couple of hundred pounds but if I had them all it would probably be into a couple of thousand easily from Jeremy Sutliffe and Blair, Oliver & co. Could I send them an SAR or are they not obliged to send anything ?

Hi Guys,

 

Just an update. I have sent DPA to Yorkshire Bank for 1 credit card and 1 cuurent account on 15 March. Had a letter back to ask me to go in to the bank to verify myself and to obtain an up to date signature as I no longer hold an account with them. Firstly, do I still stick to my 40 day deadline from the DPA or do I start agin from going into branch ? Secondly, can anyone send me a link to any info on s.69 of the limitations act ? I have been trawling through but cannot find anything in detail as I should like to go back further if I can.

 

Also, do I send Jeremy Sutcliffe a seperate DPA request with £10 fee or should it all be covered in the DPA sent to YB ?

Your appication is only complete once you have satisfied their reasonable identity requirements.

 

You should also send an SAR to the solicitors who will be obliged at least to send you all bills which have been addressed directly to you

Will send seperate SAR to Jeremy Sutliciffe. Am going into branch on Monday, so i'm presuming the 40 day time scale starts from then so thats how i'll do it. Will let you know more when I get anything back.

I have just sent my SAR request to YB to ask for my complete banking history with them. I had an account with them over 5 years ago but I am going to reclaim my charges back from 1993 - 2001. Now are they obliged to send me a list of charges pre-2001 or is it only the last 6 years they have to supply. I've got quite a few banks I want to start this with but am wondering if legally they only have to supply the last 6 years.

Thanks for that. I'm just wondering whether to get my hopes up or not as i'm sure i've read somewhere that banks are only legally required to send the last 6 years.

Ahhh so does anyone know the answer to that or is that just another thing the banks don't want to answer.....

 

Or is it a different time scale for different banks ?

Can i claim back administration charges from jeremy sutcliffe.They have debited my account £300 alltogether for missing i payment of £90 bank loan.How do i go about it. I phoned today and he said its for the letters they sent me out.I said i want a breakdown.He said it all legal. They really **** me off.

Hi Everyone,

 

I had a personal loan account held with YB over a number of years. I am attempting to reclaim my charges back so I sent off the SAR with the £10 fee. After 56 days, I received a letter as follows :-

 

With regard to your DSAR request........ Unfortunately we are unable to issue statements for your account as this is a personal loan account for which statements are not available.......

 

I'm not sure now. Surely they should be able to supply me with some information ?

 

Has anyone else come across this or is it because its a personal loan account and not a bank account ?

I have included a personal loan account in my SAR.

 

It makes no difference to what the data held by them is about. If it is about you, they are bound under the terms of the Data Protection Act to supply you with a copy on production of the fee (£10.00) and, if requested, proof of ID.
