  1. I let my property through a letting agency 8 years ago and they have managed it ever since charging me ten percent per month for the service. I now want to manage the property myself and have advised them I wish to cancel their services. I have had the same tenant throughout the last 8 years so they say I cannot cancel my agreement with them. I have read through the agreement and it doesn't mention anywhere that I cannot dispense with there services. Advice Please?

  4. I haven't started my pre 6 year claim yet, I was just going to have a read through some threads first.
  5. I initially claimed back 2001 - 2006 and was paid in full including court fees and interest. I intend to start a new claim for 1994- 2001
  6. Thanks Caro, I think you might be right about the FOS route. The pre 6 years is about £200 ish so I think I will wait a bit before starting the process again. I am happy with the outcome because it was all expected to get in the beginning and at least I hadn't started doing the bundle yet.
  7. The acceptance letter says... full & final settlement of all claims against the bank arising out of or in connection with this case. For the avoidance of doubt, by accepting the above sum, you agree not to take any further action against the bank in relation to this case, except to the extent that any such court action is neccessary to effect this settlement. So I think I am ok to bank the cheque as it does just say THIS claim only. I didn't end up amending the claim for my pre 6 years charges so hopefully I can go after those now. I will do the survey and make a donation, thanks to everyone on this site but especially Caro who always answered my queries and advised me throughout.

  9. I don't know anything about contractual interest sorry. If YB acknowledged but didn't enter a defence within the 28 days then you have won by defauult and need to apply for judgement.
  10. They don't seem to be bothering with AQ's these days. Is the 28 days up yet from when the claim was acknowledged?

  12. I know caro is unavailable at the moment but I just wondered if anyone could advise me on my situation with YB. My court date is 15th august and YB haven't submitted a defence. Any help welcome
  13. Sorry for the delay in posting, I have just moved house and couldn't find the paperwork. The letter I recieved on 11th may says in brief... The case has been allocated to small claims track.from the available papers it is estimated the hearing will take two hours. The parties are encouraged to contact each other with a view to try and settle the case or narrow the issues.The court must be informed immediatly if the case is settled. Each party must deliver to every party and the court offices copies of all documents no later than fourteen days before the hearing. Hearing date 15th august 10am. I am not sure if you need any other details Caro?
  14. Hi Caro, yes exactly that, it was showing online that the defence was entered on the 11th. It was transfered to my local court and on the 17th they asked for a 2 week stay because they said they were entering into settlement talks. I will post the exact content of the letter later because I don't have it with me. I do still have an account open with YB but I don't use it much.
  15. I contacted the court today to see why I had not recieved a defence and they told me that YB had advised them they had settled the claim. I told them a settlement hadn't been recieved and they told me just to turn up for court on august 15th. Can they get away with not entering a defence and then telling the courts we had settled?
  16. I emailed wendy melvin and I didn't get the email back rejected or unknown. 2 days after I sent the email I got my statements, it could have been a coincidence.
  17. I have not had a defence at all. When I recieved the transfer of proceedings letter there was a letter inside from kirsty ross to the court asking for a 2 week stay as they were in settlement talks. So maybe I should phone the courts.
  18. I have noticed on my paperwork that on the 11th april when the case was transferred to my local. YB asked for a 2 week stay to file their defence as they were entering into settlement discussions. I still haven't recieved the defence only the court date. Is this normal or should I have had something by now?

  20. Its just scare tactics in the media and this site is already on the case helping those involved. You are at a similar point to me, I have a court date for august and I didn't have to fill in an AQ either.
  21. I would imagine they get the same letter advising that bundles have to be submitted 14 days before. I am sure we will both get a settlement offer before the 15th.
