    • if the agreement was taken out jan 23, then she has not reached the 1/3rd mark so the car has not become protected goods under the consumer credit act.  this puts her in a very very vulnerable position regarding ever keeping the car....whereby once they have issued a default notice they can legally send a guy with a flatbed (though they are NOT BAILIFFS and have ZERO legal powers) to collect the car.  if the car is kept on the public highway then they can simply take it away and she will legally owe the whole stated amount on the agreement AND lose the car. if it's on private property i'e like a driveway, ok they shouldn't take it without her agreeing, but if they do, it's not really on but its better than a court case and an inevitable loss with the granting a return of goods order. are these 'health reasons' likely to resolve themselves in the very short term (like a couple of months?) and can she immediately begin working again ? i'e has she got a job or would have to find one?  answer the above and we'll try and help. but she looks to be between rock and a hard place . whatever happens she will still have to pay the loan off...car or no car....unless you can appeal to the finance company's better nature using health reasons to back off for xxx months.

    • Hello all,   I ordered a laptop online about 16 months ago. The laptop was faulty and I was supposed to send it back within guarantee but didn't for various reasons. I contacted the company a few months later and they said they will still fix it for me free of charge but I'd have to pay to send it to them and they will pay to send it back to me. The parcel arrived there fine. Company had fixed it and they sent it via dpd. I was working in the office so I asked my neighbours who would be in, as there's been a history of parcel thefts on our street. I had 2 neighbours who offered but when I went to update delivery instructions, their door number wasn't on the drop down despite sharing the same post code.  I then selected a neighbour who I thought would likely be in and also selected other in the safe place selection and put the number of the neighbour who I knew would definitely be in and they left my parcel outside and the parcel was stolen. DPD didn't want to deal with me and said I need to speak to the retailer. The retailer said DPD have special instructions from them not to leave a parcel outside unless specified by a customer. The retailer then said they could see my instructions said leave in a safe space but I have no porch. My front door just opens onto the road and the driver made no attempt to conceal it.  Anyway, I would like to know if I have rights here because the delivery wasn't for an item that I just bought. It was initially delivered but stopped working within the warranty period and they agreed to fix it for free.  Appreciate your help 🙏🏼   Thanks!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Has anyone ever heard of this company . Before I found this forum I sent my bank statements to this company to persue my claim MAJOR BAD MOVE :o was scared to do it myself as accounts wereover the limit for the scottish courts. I could NEVER get a hold of them. They only have a mobile contact number ?? ( the mailbox on it is constantly full ................. They very rerely reply to your E Mails. If they do the time is like 10.30 pm ?????? :evil:

 

Luckily I kept copies of my statements and are using the help of the forum

to persue myself. :p

i have had the same problems with them. i think they run this 'company' from home and dont do a good job of it, if you look ay my other posts on here you will see what i and others have had to say about them, also if you look on blagger.com they are on there and you can google them to read up about them, they are useless, i claimed back in january and they still havent done anything with regards to my claim

When I eventually asked my bank about the claim after three months, it emerged that they hadn't even contacted them. As the whole bank charge thing seems to have stalled in the courts now it may be that trusting these people with the claim has cost me a considerable amount of money. Is there any way we could publicize these incompetents more widely? Their website all sounds pretty plausible but I'd hate to think of more mugs losing out in the same way that I seem to have done.

hi just by keep announcing CLAIMYOURS will ensure that if people google them then this will come up and hopefully stop people using them it has now been 8 months that i have waited

My mate went with a company from blackpool called BankBusters, he said they were great, reasonable to,,,15% fee's....cheeper that all the others

TOTALLY debt free as of 2007, Fantastic,

I too am having a bad experience of this company. I have managed to get hold of them on few ocassions to be told that their legal department are dealing with my claim. However I have been totally unable to get hold of them for the past week and the last communication from them was to inform me that they were waiting for cleared funds so that they could proceed with the court proceedure!!!!!! I really dont like the sound of this and am extremely concerned that they have done nothing for me whatsoever.Especially when I phoned the bank and asked if they had any communication from this company and they said they have received nothing! I think I have just wasted nearly nearly 6 months waiting and I am now really p.....d off. I turned to them because I did not have the confidence to tackle it myself. Dont know where to turn now. If anyone else has had any dealings with this company please post your situation whether or not they have good or bad to say as it will help other people in a similar situation.

i waited 8 months and they kept saying the same to me, awaiting cleared funds etc, they cant be much of a company if they havent got the means to fund court action and if you look on their website it states that all claims are on hold now as they await a test case for all banks etc, do what i did and inform them that you are reporting them to to the ministyr of justice as i am not sure they are properly registered, i also know they are know as reclaim yours and nationwide finance ltd please look at this http://www.fsa.gov.uk/pubs/final/nationwide.pdf it shows they are not doing things as they should

Willowrose I have emailed them to say if I do not hear anything I will be contacting the MOJ and the FSA, dont know whether they will reply or not but I intend to contact both the above. It seems as if they are going through the same procedure with everyone but not actually doing anything. I really cant understand their logic - why take on claims they have no intention of dealing with? Have you asked them not to proceed with your claim anymore and if so have they responded? Are you now proceeding with it yourself - I really dont know which way to turn now, the proceeds of this claim would have made life so much easier for us.

hi there

i rang up nationwide to see how far along the claim process claimyours had got to and nationwide have had nothing at all from them even though i was told that it was in their legal department and going through the court process, this is all lies, i have now put my claim through the financial ombudsmen and they are dealing with it but it is on hold at the moment due to the test case

I waited for MONTHS for this company to get my money back for me. I couldn't get them by phone or fax etc. I think they work from home ?? Any E mails were replied to late at night etc........... made me very very suspicious. :confused:

 

I evevtually got fed up and wrote to them recoreded delivery demanding my statements back. I was surprised to receive them by return post.... :?:

If you have a problem with a claims company you can complain about themm here:

 

CMR: Claims Management Regulations

 

All claims companies should be registered with the Ministry Of Justice. You can check the status of a firm online as well.

A £35 pound bank charge is not a charge for a service. Its theft.
