my father had a barclaycard with a balance of £3000 and he recently passed away. I have been looking at his statements and he has charges of over £800. Am I able to claim these back as his personal representative and have therefore have the balance outstanding reduced by this amount?

This is the first time i have come come across an "estate" persuing charges. I see no reason why not. But this will bump thread to top so we can get other opinions

Sorry to hear about your father

As an unsecured debt, the balance dies with the account holder.

If you persue the £800, they might want to persue the £ 2,200....

Just inform them of his passing away, and they should close the account with a zero balance.......

Natwest Paid me again as GOGW £1,656. Yes they can have it back if they say please.

Barclays 1 Claimed £1,260. Won by default. Paid in full

Remind them that part of their extortionate charges are to insure against such eventualities......

Now this could make for an interesting case. You say that there are £800 worth of charges. I guess they would go back a few years!! So if you claim for charges plus contractual interest (knowing Barclaycard that would be about 25%APR) i am pretty sure the total of your claim would be pretty close to the original £3k

Thats true! Havent actually worked out the interest yet as was unsure wether to pursue it or not and if it had to be paid back at all, but apparently any credit card debt has to be paid from the sale of the property. Unfortunately this will leave me homeless unless I buy the house myself!

will go and work out interest now!
