  1. Thats great news, glad you got it sorted. Egg say that I need to sell the property and pay them, but other credit card just wrote it off no qibbles. Was planning to move into the property myself, but if I have to pay egg then I will have to sell it.
  2. I have also been refused by Nationwide who stated that the reason that I was in financial hardship was my own mismanagement of my account and that I should cancel all direct debits. Also because I was able to pay my priority debts such as mortgage and utilities I was not in real hardship and my loan and credit card were not a priority debt therefore I had excess income! They have totally ignored the reason that I am in hardship that I lost my job and am now in a lower paid job!
  3. Hi, I am in a similar situation. My father died and had 2 credit cards. One with Monument who immediately wrote off the debt and one with Egg who are hounding me for the money. My father has a property and hopefully when sold there will be some money left over to pay funeral expenses etc. He had no life insurance or other assets and my mother died 6 months prior to my father. When my mother died her banl loan and credit card with HSBC were immediately written off and HSBC were very helpful and understanding. Am I responsible for the debt to Egg and why did Monument write off the debt to them? Whats the latest in your situation? Any ideas ?
  4. Hi there, Things went quiet for a while from Connaught and they then passed on the debt to First Credit who have been an absolute nightmare. They have constatly contacted me asking for payment and sending letters to say that I have ignored all their letters! I have actually written to them almost on a weekly basis by recorded delivery to make offers of payment. Theyt then sent me a threatening letter saying that they would issue a stat demand. I rang them - big mistake! The person that I spoke to there was a real bully and she had me in tears on the phone, she basically told me that unless I agreed to pay £150 pm (which I cant afford) then she would make me bankrupt and she wouldnt accept any less. I offered to pay £75pm but she refusedI am still waiting to see what they do next.

Hi thanks for your reply, the letter they have sent isnt a stat demand, its a letter saying that they are now in a position to present a bankruptcy petition against me following the recent delivery of their statutory demand. However I have never received a statutory demand from them! They say in the letter that theere will be an increase in the amount I owe once they have added expenses fees and costs and they will appoint a trustee to liquidate my assets. I am really scared as I do own a property with my husband, would they be able to reposess the house, and also am worried about this demand that they say they have delivered., We recently moved house and am wondering whether they sent it there, although my post is redircted. Should I write to them? Please help!
  6. Hi I have a debt to halifax credit card for £8000 and it is being dealt with by Connaught. I requested a CCA from them on the 10th June and have had no response. I sent the letter recorded delivery so I know that they definately received it. This morning I have had a letter from them threatening bankruptcy. The letter has really scared me and I dont know what to do, should I write to them and remind them that I asked for a copy of the Credyt Agreement in June? Please help
  7. Hi I am in a similar situation with Barclaycard. Have requested Credit Agreement and received copy of application, however it says abovemy signature that this application for is a credit agreement and only to sign if you want to be legally bound by its terms. They didnt send a copy of the terms and also, under my signature is a space that should have been signed by an authorised Barclaycard signatory, but it hasnt been signed. Does this mean that it is unenforcable as they havent signed it?

  9. The card debt is for approx £8000 I am embarrassed to say. Thanks for that advice , I will send the letter off tomorrow. When you say I should put 'I do not acknowledge this debt@ at the top of the letter, does it matter that I have been in correspondence with First Credit by post for the past couple of months and I have never put this statement on the letters? (I changed my tel number as the constant calls were making me so stressed out so the only way they can now contact me is by letter) thanks
  10. Hi Jadzia found your thread really interesting as I received a very nasty letter from Connaught today threatening bankruptcy. Had a Halifax credit card and first credit have been dealing with it, I have made several offers of monthly payments which they keep refusing and they have now passed it on to Connaught. Am new to this, so can you tell me will First Credit have bought the debt from Halifax or are they usually just acting on their behalf? And should I send one of these CCA letters to them? Help!!!!
  11. Hi I received an almost identical letter to yours from Cobbetts last week and was in a right old state as I didnt even understand half of what they were asking me! The following day I received a letter from RBS offering to repay me the full amount I had claimed (but not the interest) . After the sleepless night I had worrying about the letter from Cobbetts, I decided to accept the £2200 and run! You may get an offer from RBS very soon, just as I did. Good luck!

Havent actually worked out the interest yet as was unsure wether to pursue it or not and if it had to be paid back at all, but apparently any credit card debt has to be paid from the sale of the property. Unfortunately this will leave me homeless unless I buy the house myself! will go and work out interest now!
  13. Hi ditto Linzi, I have been hounded by Cabot, Blair Oliver Scott and Eurodebt forthe past 12 months and was wondering if I could do the same. Do I understand this correctly, the lender is supposed to sign the credit agreement as well as yourself when you take out the loan/credit card etc and the dca should be able to provide you with a copy, if not, they cannot enforce the debt? any help appreciated, am new to this and have been ill with all the stress and harrassment from the dcas
  14. thanks for that, Barclaycard have said that as he owned a property and it was in his sole name I have to sell it in order to pay them their £2200.
  15. my father had a barclaycard with a balance of £3000 and he recently passed away. I have been looking at his statements and he has charges of over £800. Am I able to claim these back as his personal representative and have therefore have the balance outstanding reduced by this amount?
