    • Hello I hope someone can give me some advice here, as I am at a bit of a loss on how to proceed. This relates to alleged offences under the RTA. Yesterday I received a notification from the local police of intention to prosecute for the following offences: 1 driving without due care and attention 2 failing to stop at a road traffic accident 3 failing to report a road traffic accident At this stage they have only asked me to say whether I was the driver at the time or not and provided a blank sheet of paper to give information about the incident. Going by the location (just round the corner from where I live) I can only imagine this relating to one recent incident, which wasn't actually an accident but more of a road rage event. I was driving past someone unloading or working next to his lorry which had stopped in the road. I wasn't going fast or anything, while I went by lorry man turned around and punched and kicked my car whilst going past him. I stopped and got out and wanted to know what he thought he was doing punching and kicking my car. He then hurled some verbal abuse at me, swearing and he was quite aggressive. I still didn't know what his problem was and said I would report him to his company for threatening behaviour and vandalism for punching my car. I got my phone and tried to take a photo of his lorry and number plate but at that moment he came right at me, still shouting and swearing, so I was worried he may hit me next, as he already punched my car. I thought if the guy hits me I will come off second best, so I decided to retreat. I quickly got back into my car and left. When I checked my phone later the photo I tried to take was blurred and useless, so I thought it was pointless to report the incident to the police, as the guy would not be traceable. Over that I forgot about it until I got the letter yesterday in the post. This is the only thing I believe this can relate to, but I have no idea based on what the three above allegations come from There was no road traffic accident, more of a road rage incident. So I am at a loss what to do. I have 28 days to respond. Should I just say yes I was the driver and was there and see what happens next, or should I already make a written statement on the attached piece of paper they sent me and send that with it ? Is there anyone here who would have a rough idea what to do next ? I tried my legal advice line through my Union, but they have sent me from pillar to post, now say it needs to go to a different department again and that would be chargeable as the RTA comes under Criminal Law. So any advice would be appreciated Many Thanks
    • So a quick update got bounced around two different departments and managed to speak to a DVLA bod , explained the situation and they could see the overlap and that DD payments had been made from Feb , also no formal remiders prior , they gave me a number for the legal dept who I am calling this morning to see what they can do in terms of the SJP notice , still have time to submit this online.  Will update after my chat this morning 
    • Also, I am trying to understand how invoicing a large sum in a 6m period becomes tax fraud?   Is it because if he had invoiced over the £85k threshold he should have been obligated to charge vat?  Which would have meant hmrc would have benefited from the vat amount? So by not charging it Hmrc have lost out on £s revenue?  Is that what makes it tax fraud? So as a self-employed contractor, let's say he invoiced one Co for 200k.  Should he have charged vat on the full 200k (£40k)? Or just on the sum above the threshold (£23k)?  And that by not charging vat, he has knowingly withheld tax £s from Hmrc? And is the payer complicit ?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

As above. Designed to put the frighteners on you. Newlyn may have a bailiff side to their company, but bailiffs are only instructed when a court finds someone guilty of something and that someone still refuses to pay.

 

A few more letters to go yet.

Hello everyone...im new to this site. Found it on google after reciving a disgusting letter from the EVIL CEL!!!:mad:

 

I rec a PARKING CONTRAVENTION sat 27th feb 2010, for parking at Milton Keynes (THE HUBB) couldnt beleive it, for parking at the hubb. They have billed me for 15mins.

I felt sick when i rec this, i dont know what to do.

I took a drive today to read the notices outside where i partked, took photographis evidence, and in VERY small print it has the T&C's regarding no ticket etc etc...i dont get it!!!

 

When i see all the comment, i feel to leave it, but then i dont want any baliffts knowcking at my door for payment.

 

Its good reading as what to do next etc...But im a bit confused!!:confused:

Should i right to them? what do i put? What do i say?

Is there a template i can edit my details from the letter and send off via recorded delivery!

 

I ned help guys. the worst thing is, im on maternity leave, funds are limited and dont need £75/150 to add to debt!!:(

I really dont want to leave it, and then £75/150 turns into £1000s because of court fees etc...:(

Please read all the advice on this forum. Do not contact the parking company and ignore any correspondence from them. You have not broken any law and you have done nothing wrong. They will not take you to court. As for bailiffs they only come on to the scene if the case goes to court ( very unlikely), you lose (very, very unlikely) and you refuse to pay whatever the judge orders. But, as I have said above the case will not go to court.

 

Do not confuse bailiffs with debt collectors. The former are officers of the court (see above) but debt collectors are just private citizens with no special powers. They cannot enter your property, they cannot seize goods and they cannot blacken your credit record. If they do come knocking just tell them to leave your property or you will call the police.

You are not supposed to, don't get to involved with photographs and journeys back and forth to check things.

Why waste YOUR time and money, te default advice is not to engage them, give them nothing to go on.

You do realise it is a [problem] don't you? What makes you think you will be he one that actually goes to court? Loads of posters on here have begged the ppc's to take them to court but without result. They wont take you to court and if by some miracle they did, please tell me how £7 will turn into £1,000s?

I did unfortunately write a letter and sent it recoreded delivery to say i wasnt going to pay etc (copied from Rob S template,thanks) i did it yesterday so i wil see what happens.

Just looking on there website, has anyone posted it up....?

First it has now cost you money.

Second they will probably up the threat rate of their letters as they now realise their letters are getting through to someone.

Hiya...

After reading i know NOW i shouldnt off, but i didnt wanna sit on it and not do nothing..sort off, i know what im like...!

 

So do you reckon i shouldnt send anythign else off, should i get a reply?

 

The really annoying thing is, my friend parked exactly next to me,at the same place and she hasnt recived anything and i have - which is really UNFAIR.

 

FUNK it, im not going to pay...god help me!

 

So is there any evidence that all the other peopel on this forum regarding the evil company have had it wiped and nothing more about it has been done and they have agreedv to leave it?...And that it hasnt built up to a mass sum they have to pay!

The "evidence" that the ignore route works is that there are not 100's of people coming back posting on the forum saying "I was told to ignore their 50quid scamvoice and now I'm up in court for 300quid!"

 

The reality is that many people are told to ignore them and do just that and never hear from the PPC again after they have tried their 5 or 6 letter [problem]. The PPC never "agree" to leave it, but who gives a toss whether they agree to drop it or not, they are not getting any money either way. :D

The area near the Hub is opposite sideof the road to Sainsburys and is in front of the Vizion development. It looks like any of MK's parking areas, the signs are obscure and I think if I was the owner of this private land, I would not employ a despicable, [causing problems] company like CEL to extort money out of unsuspecting visitors. At least they won't get any money from me.:p

Just come across your site!! I have got one of these "fines??" the other day and I'm not sure what to do? I have read the other posts but I'm on the fence, I cant afford the £75 ,let alone £150 plus costs.

They say if I dont pay they will forward the account to a debt recovery agency. Is the advise the same as the rest, the first letter saying I was not driving and them ignore the rest?

In the very unlikely event that they do come to your door just tell them to go away, or you will call the police.

 

Bailiffs are "officers of the court". But they would only come on the scene if the case goes to court (very unlikely), you lose the case (very, very unlikely) and you refuse to pay whatever the judge orders.

Thanks.

I've been told not to contact them at all, but of corse I have contacted them ,by phone. I said I could not read the sign as the writing was to small and they advised to pay the "fine" and them appeal in writing.

read the many threads and a few there about the odd PPc that did try the court route and lost , Excel is one of the biggest fools that tried it

Well well well.....i recieve a response back from them, from my first letter!

 

They put... 'We considered the matter raised,and regret to inform you thye are unable to cancel the enforcement notice...blah, blah, blah!!

They put the car park has expeienced severe problems with un-authorised parking, resulting in vehicles being parked long periods of time and occupying valuable.

 

I have already drafted my next letter...I know u guys are saying to sit back and ignore it. But someone like me and like yourselfs also i have never been in this sort of 'trouble' before and to just sit on it and do nothing is making me a bit uneasy...

 

Gota be seen to be doing something, cos if this goes further, they can see i have been trying to dispute it! (for all its worth)

 

More money out my pocket(postage 39p) i mean...want to see the answers to my questions and take it from there!
