right i have written a letter to ge asking if we can reduce the amount we are paying on the arrears , with the amount ive offered it will still be paid by december this year i have also enclosed an income and expenditure sheet and told them i will be attending court to put my proposals to the judge and that i will also be showing the the copy of the income and expenditure form i have sent to them and also a copy of the letter i have just written them im not holding out much hope but the proposals are reasonable hopefully they will accept

If they dont agree and the Judge accepts what you say and makes that the payment you can ask him not to make you pay their costs as they were unreasonable in not accepting your offer thus inccuring costs

only problem is the income and expenditure on the court papers is different to what i have done today, i totally ballsed it up:confused: all i can do is tell the judge about the reduction in my tax credits( which has happened since we filed the court papers) and that i calculated things wrongly

That will be ok, make sure you take 3 copies of the amended I & E statement to court with you and give a copy to the judge. You could also send a copy to the court with a covering letter (make sure you put case number, court date etc on the letter in large Print!) asking them to attach it to your papers.

 

If your circumstances have changed since you sent the court papers back, the court will take that into consideration.

thats ok then , im going to the cab tomorrow to see what they say. trouble was with the I&E at the moment my electric is costing me about £80 a month as i am on a prepayment meter and my fire is electric and also im using the dryer a lot more but in 2 or 3 months time when it warms up (hopefully) i will only be spending about £30 to £40 a month, same with the gas at the moment im spendin £40 a month but come spring it will only be about £15 a month, so at the moment everything is costing more i will explain all this at court, plus our travelling expenses have gone up as im taking hubby to work before he was getting a lift.

went to the CAB this morning what a farse! we sat there for 3 hours and in the end we had to leave without being seen because hubby had to go to work, i asked if we could make an appointment but she said we had to be screened first in order to determin wether we need an appointment. there is someone available at the court on the day of the hearing but i would have preferred to see someone before then but i cant go next week as kids are off school and im not sitting there for another 3 hours again. what a horrible place it was aswell (never been before)im going to send my letter and hope for the best.

I think you'll find you will be OK if you send the letter to the court as I advised yesterday. There probably isn't anything else the CAB could tell or advise you to do at this stage anyway.

 

Stay positive and keep posting for support until the court date. It will work out fine I'm sure.
