    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Guys, hope all well.

 

You are right and it offers possibilities.

 

Several issues where they can fall down, if the issues are raised.

 

1 Non compliance in providing banking history

2 Treating everyone differently- lack of consistency in approach and response to requests for payment

3 Forcing court route when they will pay- wasting court resources etc

4 Stages of offers- refusal, then % increases

5 Wasting ombudsman time- every case successful

 

etc etc

4 lots of statements received in the post and a letter, which I will post after this.

 

2 lots of statements, exact same run, for same account. However, I already have 3 copies of statements for that account, so 5 in total and counting. Interestingly, these statements only go back to December 2000. Earlier, they gave me statements going back to 1998 on the account. They are:

 

concealing information

being daft

mad

quite poor at adminisitration and don't know what records they have (haha)

absolutely bxxxxxx awful

not playing the game

on something

 

statements (part) for a closed account, already got (waste of time)

 

Statements for a capital bank loan, part of HBOS. Glad to get these- £345 plus interest.

 

They never learn and due to the fact they have not merged their systems/ procedures and cut back on staff, they are all over the place.

Find the weak spot.

Think David and Goliath, Think Independence Day!!!

Oh Kenny, you know I've been there too - it's so frustrating dealing with these people. And while it is extremely tempting to fall into a slanging session because it makes us feel better, we know in our hearts that they are not so stupid.

 

We know in our hearts that these are carefully thought out tactics to obfuscate, confuse and discourage. But don't lose heart, 'cos we're onto 'em!

 

I know I've done it so many times, posted about how idiotic these people are - but the scales have fallen from my eyes now.

 

These temporary teams that have been brought together to handle charging complaints are deliberately managed just well enough to give the impression that they are attempting to fulfil their bosses' obligations under the Data Protection Act; yet just badly enough so you never get what you ask for.

 

We'll get them in the end, though pal ;)

Enquired to BoS re hardship case criteria during OFT case as it applies to a lot of people on here.

 

I asked for their definition of what would be considered a hardship case. The reply was not unexpected.

 

Whilst the staff member vaguely remembered being briefed on it, she claimed not to have had a circular or handout that she could quote from. She said that anyone claiming hardship would need to go to court to prove this to allow the bank to process a claim for refund of charges.

 

Only posting what I was told. I will pursue this. I suggest that anyone who thinks they should be dealt with as a hardship case phones and writes to their bank requesting to be considered as a hardship case.

Received update letter from bos re OFT case. Enclosed a form for me to sign re the goodwill payment they made.

 

 

Will try to scan the letter tomorrow so that everyone can read it. We may need a new thread on this. The letter seems similar to that received by others.

 

Interestingly, the 2nd large para says that.......................................

 

"for customers for whom Scotland is the most likely jurisdiction, your right to refer your complaint to the Financial Ombudsman Scheme (sic) will not be affected. The FOS provides a convenient alternative to the courts and is free"

 

Now..................is this true????

 

Why??? Difference between Scotland and England.
