      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

In reply I'm sure your letters to Green and co and Intrum would be appropriate. I would start to get tough and state you have taken Legal Advise and are considering Court action to resolve this matter.

 

Have you tried a CPR request on the current owners of this account?

Your right about Greens letter I had forgotten that. You know my thread better than I do. Now as I have a new PC system since all that business with greens I will have to find it on my hard drive. :)

 

I think I will send an appropriate version of the Greens Letter. It stopped them in their tracks, so perhaps it will do the same for Nelson-Guest.

What happened to CAG this morning. Everything went dead :)

 

Quick update

 

Westcots still phoning once a day. They are now getting cheeky and asking who I am. I take the message and then ignore it all. My dispute is still with NatWest for not supplying a legal CCA. What's it got to do with Westcots?

 

I don't get on CAG much these days as I do a lot of voluntary work, so my time is pretty much full up.

 

I will update whenever I have news.

Happens once and a while MB.. doesn't last long though.

 

Suppose you have done the harassment letter. There is a much stronger version ( i think by Steven?) that might do the trick. I'll try and find it later.

 

Been passed to westcots eh. I've dealt with them myself and they are all huff and bluff with no substance.

Hi folks

 

This is an update and also a query which I don't know where to put.

 

Nothing further to add. Westcots still phoning once a day. Don't even bother to answer now. My phone is on permanent answer mode or unplugged so it is their phone bill going up not mine.

 

Obviously I did not get a reply to the company secretary letter I sent.

So it is still a waiting game.

 

Now here is an odd question. (nothing to do with banks or charges, but I have searched the internet with no luck). Someone on here may know.

 

My hubby is looking for a tool which we don't know the name of.

I can only describe it.

 

It is like a holder with lots of loose pins in it that you put against an uneven surface or upright and the pins move to give you an outline of what you want to put a pattern round (i.e cutting flooring round doorways).. It looks like a comb but the pins move in or out to give you a pattern.

 

Similar to one of those hand things that you put against anything and the nails form a 3d of your hand or whatever.

 

If anyone know the name of this tool I might be able to find one on the internet.

Something else I have just thought of. Why don't I get emails anymore to tell me that someone has replied on my thread? They used to come all the time, but now I don't know if anyone has replied without looking on CAG, and sometimes I cannot get round to that. They were very useful.

Hi HHNF

 

Thanks for the tip about the emails. They made me keep up with my threads.

 

Hope all is well with you. I am better than last year now but have bad arthritis. :-|

 

This tool thing is like a comb with moveable pins that if you put it up against a doorframe (on the floor) the pins will move to the shape of the wood and give you a pattern of the door jamb. It makes it very easy to cut flooring and carpet etc. as the pins form the shape of the door jamb.

 

Its one of those things you have to find out about, like a song that goes round and round in your head and you can't think of the name of it. :roll:

 

Hubby thinks it is a pin guide or something like that.

 

So Southend are chasing you too now. Its only down the road from me about 15 miles, so if you like I'll go and tell them to leave you alone. :D

 

ITs now been almost two years since my battle with them and they do move exceedingly slow so you have plenty of time to plan your strategies.

I have one of those things MB. Used it for tiling (created the shape where a tile will fit). Afraid i don't know the name of it though and couldn't see it while browsing. Going to sort my junk out in the garage tomorrow and see if i can find it. If it doesn't have a name on the side then i'll photograph and send you a pic.. at least that way you can email it to some DIY places or take it in to one and say "what the hell is this and do you have one?". :)

Today I got a threatening letter from Westcots. Funny thing, they were threatening legal action before Christmas, now they are threatening to pass this on to a doorstep recovery service. Won't wash with me.

 

I have seen a letter somewhere on this site about writing to these people telling them they are out of order as this is a serious dispute. Can anyone remember where it is?

 

I have one somewhere but can I find it? I think the shed monster has eaten that as well.

 

I would be grateful if anyone can point out a suitable letter for me. I haven't a clue where to start.

At the moment there is no harassment. The phone calls have ceased :)

 

Guess what folks, today I got a letter from Westcots. They have acknowledged a query on the account, and all activities (letters and phone calls) are suspended while they investigate the whole matter.

 

This may take several weeks, and they will appreciate my patience during this time. :-D

 

Interesting development this, don't you think?

 

They will not find a valid CCA and they will have to pass it back to Nasty West.

 

Yet another DCA bites the dust.

 

Mind you, I think Nat West are more to blame here, as they pass these accounts with alleged debts on to DCA's without the proper papers or legal authority to do so. The way the banks are acting lately, they deserve all the stick they get.

 

Onwards and upwards folks.

Hi:

 

I have send the Subject Access Request letter to the NatWest concerning my loan together with the £10 postal order. Today I received the answer and all I got is a piece of paper with my loan paymnet installements since I started, my name and account number and dates. There's no information about PPI or anything I see relevante? Don't tell I just paid £10 for a printed statement. That I can print myself from the internet banking. I have sent the Subject Access Request exactly as shown here and only editing my details.

 

Any ideas?

Bank charge successes:

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Cap one Now with the FOS

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

 

1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

No development with my case. I expect all will go silent for a few weeks.

 

Forgot to mention. A few weeks ago I got a brown parcel through the post will all my statements from Nat West.

 

Had to laugh though. It is only about 18 months after my SAR. I had forgotten all about it. Its quite amazing how these people operate. Did someone have a dull day and decided to find something to do after all this time?

 

News as and when it falls in my lap. I am not holding my breath :rolleyes:

I spoke too soon.

 

Still had no letter telling me what their investigation has found, but the phone calls have started again, despite their statement that all communication will cease until they have investigated.

 

Then I got a letter offering me a settlement, :rolleyes: but I must phone their office blah, blah, blah. I don't think so.

 

They will receive a strong letter accusing them of not sticking to their statement that all collection activities will cease until they have investigated.

 

Lets see what that brings.

 

I do have a lot of dogsitters though. Every time I get a call I say I am the dogsitter. :D

HI All

 

Not been on for a while as there really hasn't been anything to update, and I went deaf (don't laugh).:)

 

I got a letter from Westcots stating that after they had investigated the issue I raised with them they would not be dealing further with me and I should get back to the NAT WEST

 

Since then not a peep from anyone. :confused:

 

I guess its back to the waiting game.
