    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

anyway noone can stop your mum visiting even if she is mrsa as the staff on the ward wont know if u dont tell her. wards are full of visitors with infections who dont tell the staff just in case theyre kept away and they cant do anything about it....acturally that is not a good thing to tell u coz maybe thats how infections get into hospitals bu t u know what i mean. mum cant be stopped unless they know shes got mrsa and u can hide that like other visitors do.Keep away from other patients and vistors too not just the staff.dont ever let any other people near your baby and not even after you get home for a while too they could be carrying anything-most healthy people have mrsa but have no symptoms.good luck m8

At the risk of being shot down in flames.............The majority of infections in hospitals are communicated by visitors and it is attitudes like this that contribute to the problem. NO-ONE with a known problem like this should be visiting and EVERYONE should be scrupulous with hand hygiene!

They weren't! It's just that now we have some particularly nasty resistant strains, due in part to the overuse of antibiotics.

Also NHS bashing is now a more popular media sport than it used to be so wheras previously it didn't get reported.

Its a media sport is it. You wish!

As I have 1st hand experience of the caring community & its practices I don't rely on the press. I already know what goes on & it's now coming to the notice of the media thank goodness. The trouble is there are too many who don't care & the ones who do do nowt about it when they see maltreatment

Also if the over use of antibionics is part of the problem who's fault is that then... the sick!

Can I play devil's advocate and state that recent surveys have found over 40% of NHS hospitals have a "moderate to severe" problem with MRSA and private institutes report less than 10% of infectious diseases?

C.Diff is also more prevalent in NHS hospitals, with over 34 people dying from this infection in a certain NHS hospital in 2005?

I have seen it for myself, it's the staff. Argue if you like, but I saw a nurse change a drip and then change a dressing on my partner...no washing or scrubbing of the hands, was a bit like a production line!

err, yes actually, well, at least in part. people expect to be go to their GP and get a pill for everything. the public demands they be given antibiotics. that is also of course the fault of the medical profession for not saying to people 'actually, there isn't anything we can give you, you'll just have to wait to get better'. there is a broader education issue here, which applies through the system. A&E departments and GP surgeries are stuffed with peole who don't need to be there and shouldn't be there.

C diff is properly nasty, I know I've had it, despite scrupulous barrier nursing. thats because it is both a contact and airborne pathogen. the only way to control it's spread effectively is isolation, but the hospitals won't do that because that means closing beds, but thats not the fault of the doctors and the nurses. Hand washing helps, but it is far from the total answer. those at the front line (with, certainly some notable exceptions) do their best to try and help people under extremely difficult and demanding circumstances. they are not the enemy. They are in this job because they want to try and help people, improve peoples quality of life, or indeed death.

and if you don't believe how hard it is, consider this. the average burn out time for an A&E nurse is now just 5 years. If you want an NHS that is well staffed by motivated well trained and consientious individuals (which by default means exactly the sort of care you are all clamouring for, quite rightly)then they need the public support. take the criticisms inherant or invoked by the system to those that run the system.

yes, you can state that by all means. can I state that as 40% of the general population carry MRSA as part of their natural skin flora that figure for the NHS doesn't seem very suprising. so why the lower figure for the private sector? well it could have something to do with the fact that they don't routinely screen patients for it, and also a private hospital wouldn't go anywhere near the sort of patients that are particularly vulnerable to an MRSA infection. their pathology is far to complex to make money out of!!

like I say, when you know what is the real truth behind those figures the press likes to throw around, you become slightly more sceptical about things!

  • 1 year later...

She's quite ill has a bad heart condition and a hernia the size of a football (which they refuse to operate on but thats another story) and she has to have a catheta 24/7 too.

Tuesday she started to get a lot of blood in her urine and felt quite uncomfortable (which shes been complaining about for a long time). The GPs initial reaction was well u have an appt at the hospital with the urologist on Monday (next week)can you wait till then now bearing in mind the amount of blood loss and large clots does anyone think that GP is off his rocker considering she was in pain and passing a lot of blood?

They called the GP back and he said I am going to be in clinic now so i'll come out later (they live 2 mins away literally almost next door).

GP sent a nurse out to have a look and reported back to the GP that she should go to the hospital, by now dark blood and clots pouring out. GP says can you get to the hospital or do you need transport so she says transport he calls up normal hospital transport and says it will be FOUR hours so she got herself there which could have done even more damage, I said she should have dialled 999 but shes old and doesnt want to make a fuss, ffs :(

Now she's in hospital been there since yesterday and they STILL havent done a single ******* test on her just stuck her away in a room on her own (thank god) shes in incredible pain as her catheta keeps getting blocked by clots and they cant give her anything.

Rich,

I am so sorry that you, your GF and her Mum are going through this at the moment and my heart goes out to you all.

I think you and your GF need to go and speak to the Ward Sister/Charge Nurse in the first instance and ask about her care plan, what are they hoping to do, is there delays with some of the tests being carried out, do they need specialists to come and do the tests etc?

If that isn't satisfactory, you may wish to speak to the consultant in charge of her care or his registrar and voice your concerns about delays in the care and the lack of any seemingly structured plan to achieve a remedy to the problem.

If all else fails, speak to the Patient Liasion Co-ordinator, who can act as a go between/ mediator, I had to use them recently and found them incredibly useful.

Wishing you all the best and your GF's Mum a speedy recovery.

TF x

All my knowledge has been gained from personal experience and the sharing of advice from fellow members.

  • 2 months later...

My gf's mum has just been confirmed as having MRSA again for the 5th time she gets it everytime she's admitted to this hospital but never when she goes into Addenbrookes.

Her skin was tested and she's not a carrier on top of everything else they have done to her we're hoping she will listen and speak to a solicitor now all she wants is the treatment she needs without being made seriously ill each time it's not about compensation before anyone jumps on this and defends the NHS.

Things is last time she got it was when our son was born so she wasnt allowed to see him till he was 4 weeks old and my partner is now 3 months pregnant again so we cant visit her in hospital and the way things are going she wont be clear by the time this baby is born so will be in the same situation as before :(

The treatment for MRSA only takes days if it is present in the nose/skin, longer if it is in a wound/blood. So she should be well clear by the time baby is born.

Whereabouts is she MRSA positive? Is this diagnosed soon after admission to hospital or further into her stay? Do Addenbrooks test every patietn on every admission (if they do not test they would not know it was present). More info needed I think if you want specific advise.

We speak from previous expierence from the previous times she's had MRSA if the person has other problems like I said she had it before in her post op wound this time last year and it took over 12 months to sort it out.

she has a hernia the size of a rugby ball that they refuse to do anything about as she has a heart condition they wont even offer to do it under epidural and because of this they cant use a probe to see what the problems are because they cant get passed the hernia.

The last time this happened they refused to send out the nurses to change her dressing at home and said that her carer (who is 71) should do it but to change it you have to lift the hernia and she cant lift it and they still refused to send a nurse out to change it despite the fact she lives 50 yards from her GP and they also refused to change it for her even if she went to the surgery.

she also suffers from terrible anxiety and stress when away from home so all in all not very good.

This was diagnosed hours after her op as her temp and blood pressure shot up so we presume its blood borne now we can't find out for sure as they wont let anyone in the hospital now because of the vomiting and diarhea bug and there are no phones (or tv's) on the ward.

Latest update she has been sent home because of this vomiting bug going round, she's still ill but get this it's too dangerous to keep her in hospital ffs.

Dr told her today they have never seen someone get so ill so fast make it back and they were expecting her to die.

Absolutely disgraceful as a friend of mine says the NHS bury their mistakes, luckily my partners mum escaped this time, we're going to write to the trust and her GP demanding she is never sent back to that hospital EVER again

She is going to do so but she's nearly 60 and suffers from anxiety and isn't very assertive (which is part of the problem she wont stand up for herself)

They refused to give her the letter that you usually get from the hospital to give to your GP and said they will post it and despite repeatedly asking they refused hmmmmmmm.

We'll give it awhile for the records to be updated and get her to have look

Thanks
