Hello all - was directed here from Martin's Money Tips, and am now looking forward to getting stuck in!

 

I accidentally went over my £100 agreed overdraft in April for the first time in ~10 years. Charges in 3 days amounted to >£140. Also, timing of the "offence" meant that I had no time to correct the problem before being overdrawn at the start of May too - another set of charges in excess of £100!

 

Sent letter about first set of fees on 06/05/06, and got reply back on 13th. Alas - no joy - reason for charges being "...we have to manually intervene, so have to pass on costs to the account that generated them".

They also suggest that I contact their costomer relations dept where I can discuss with one of their 'specialists' the "issues I raised with regard to UK Law in respect of Data Protection and Consumer Credit Acts".

I have no desire to speak with a specialist (since I'm not one myself!). My intention now is to:

 

a) Ignore their suggestion to talk to their specialist

 

b) Issue the request for details of all charges in last six (is it 6 or 5 in Scottish Law?) years

 

c) Move on to Small Claims procedure.

 

Would this be the right way to procede ?

It would have been best requesting a list of charges before you sent the first letter.

 

If you look in the FAQs there is a step-by-step guide. Have a thorough look at this as well as browsing around the forums and you will have an understanding of what you need to do to get your charges back, and the order in which things need to be done.

hi this is my first question after my husband loosing his job we went over drawn and had loads of charges from halifax so to stop us going down the bank rupt route we went to cccs for help so having to close my account with halifax and nat west but owing them each £1000 which was made up of over draft and charges and we are paying this off monthly can i still claim charges back 5 years even though we dont bank there any more and own them money ????

:) Yes Tina you can claim back those charges even though the account is closed.
