If you disagree, exactly why do you believe the Council have been negligent ?   Does your wife have any disability that the sports centre staff were aware of and they were offering assistance to her during her visit to the centre ?     • Hi Sorry for uploading them wrong. Im not technical at all and self taught so bear with me as im trying my best. Thank you for all the info regarding the signs, this was my thoughts as well. Yes they have changed teh signs since this happened Ill ahve to have a look back through and see if when I took the pictures they were already the new ones or I have the old ones. I cant remember off hand. With regards to Europarks running the site now, Just to make you aware there is another small retail park just across the road and Im sure they are Europarks. The shops within that park are just Aldi and B & M. The site that we received the NTK has a few more shops, Home bargains, The food Warehouse, M & S food and a few others. I put these for identififcation purposes just in case it is the other site that you were looking at. The main entrance sign is on the bend on the left as you drive in the entrance so when you drive in from the right and turn in you can see it in front of you but if you drive in from the other way as we do then you dont see it unless you know its there and as you say you would have to stop to read it al anywayl. The main thing that always jumped out at us was FREE PARKING FOR CUSTOMERS ONLY in large letters.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

that is what they said to me money was in by bank the next afternoon and letter arrived following day keep checking your account (as if you need telling )let us know i knew you would have your money before i had the baby

I think I have won as I have a letter here stating that Halifax are willing to pay my charges back and 8% interest and that it will be in my bank within 14days

 

so I havent really won intill the money is in my bank!

I know how you feel lisa but must be more frustrating for you cos they sent you a letter saying they was going to pay you!! i am sure you will get it soon though although i know it dosnt make you feel any better lol xx

they were ment to achknowledge last thursday but instead of acknowledging they sent me the letter saying they will pay up in 14days. that ends a week thursday!

Hi all, just to let you know I have practically finished my claim with the Halifax. They owed me £1,700.00. They originally offered me £893.00 as a gesture of goodwill and I wrote back saying it wasn't accepted in full payment but only on account and giving them 7 days to pay the remainder before I issued. I left it another month and then rang a couple of days ago saying that if the file handler didn't call me back that day then I would issue. He did call back and he offered £1,450, which I turned down. We than agreed £1,600.00. For some reason they seem to think they took back the £893.00 already paid into my account? and have said £1,600.00 will be credited into my account within the next week or so. So there ya go, just keep on the phone to them complaining and threatening all the time and it seems to get you somewhere!

Lisa.... hang on in there ... it will come in the end... they did the same with me, :mad: paid charges of £3864 but no interest...had to go to court to get the interest of £932.. and then they still paid up short by about £80!!!! but in the end they will have to pay...i will let it run to the next hearing date even for 80 quid.. if they want to play silly beggars...
