    • OK thx jk2054 I'll go that route, does anybody have any positive reviews of NWNF law firms they've had experience with? I did consider InjuryLawyers4u, but apparently they're more of a broker, & who you end up dealing with can be hit & miss.  Would rather try & get a sharp firm that are on-top of things if possible.   
    • I posted my letter off but over 2 weeks later I've had a visit from one of their reps. I didn't indulge him in any conversation, and I just stated that any such debts are statute-barred and closed the door on him. I was hoping they'd take notice of the letter. Where do I go from here? Thanks
    • I apologise if I was being unclear. Where it currently stands is that they will have it repair, placing scaffolding in our garden for 5 days. They have moved fast, but we will still have to postpone our contractors, meaning, we won't necessarily have the work done in time for the wedding and therefore will incur additional expenses for either a marquee or a wedding venue. They are vehemently against having any kind of liability in any regard but continue repeating that they are legally entitled to use our garden for their repairs (I believe this is true unless the work can be carried out using a cherry picker). The neighbour seems either indifferent or oblivious to the fact they can't reach all of the side of the roof from the space where they can place the scaffolding. They have asked their roofer of choice about using a cherry picker but the roofer has said it wasn't possible. It's not clear whether the roofer doesn't want to use a cherry picker or whether there is an issue with it. They have told us it is a problem that we are installing a gazebo as it will prevent them to access their roof from our garden in the future?!?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello all!

 

I really need some advise please.

 

I got a letter through the post today from a company called Cabot Financial.

 

It related to a Barclaycard I had a few years back about 5 years ago I think.

 

Anyhoo I called them up and tried to arrange a settlement with them. They want over £1100 off me:shock: !

 

I lived at a different address when I had the Barclaycard and a collection company offered me a settlement of £500. But I just moved and ignored it:rolleyes: .

 

Cabot refused this offer when I asked them if they'd accept £500 and wanted £900, after a bit more talking they went down to £750. I then offered £650 but they wouldn't budge.

 

So the telephone conversation ended there. She said she'd put the offer in writing and send it to me and I also said that I'd put my offer in writing and send it to them. I said that I would pay the £500 in £100 instalment per week.

 

Any advise!!!!

NEVER EVER communicate with these people over the phone! And I mean NEVER EVER! Always have it in writting.

 

WHat you need to do first is to send them CCA request via recorded delivery and a cheque for £1 - please, go through the other threads - there are templates of the letter you have to send and explanation of how the process goes - also check Dealing with Cabot 101 thread in the stricky threads area.

 

See what they reply to your CCA and take it from there.

It might be worth also sending a SAR to Barclaycard. You say the debt was "about" five years ago, if it's six or more it could be Statute Barred.

 

Plus if it's made up of unauthorised charges you should be claiming those back, have a look in the Bank Charges section for more details.

 

To echo what Sve says, keep all your dealings with Cabot in writing and make sure every letter includes the line I do not acknowledge any debt to your company. :)

  • Cabot: I'm still waiting for an enforcable agreement, more than a year after requesting it. Go on, Uncle Ken, take me to court if you dare. You know you want to!

  • Ashbourne Management (gym membership): Finally got my default removed and out-of-court settlement; I'm not finished with them yet!

I was just thinking - You could send for your Credit Reference Agency file from Experian or Equifax it costs £2 can do it online or by post it usually takes about a week to come through the post - this way you'll see exactly who is writing about your credit history (Cabot often write under the name Kings Hill No1 Ltd too) also you'll see shown the date of default and the amount defaulted etc.. so will know exactly the amounts etc.. You say you moved addresses - so write to Experian your old address etc.. so they will be able to track the correct address for you. It's worth £2 to see what is being written?

 

It may be worthwhile sending an SAR to "both" Cabots and Barclaycard and make a point of asking for all the information they have on you to include deed of assignment, letters, default notices, transropts of any telephone calls, any manual intervention with the account involved etc.. - you should get everything for the full history of the Barclaycard that way (most companies interpret the SAR to be for Data covering the last 6 years - when infact you want the whole lot of Data if it's an account older than 6 years?) this way you should have everything you need to sort this out - if you have charges that go back further than 6 years you can claim them back too.

 

The CCA as above is also good to ask for as this way you'll see whether debt is enforceable or not.

 

In the template library are the template letters you can edit by "copy & pasting" to your needs. Keep a note of your dates so you'll be able to know whether these requests are met or not - often these companies do go into default.

 

The best advice here is to read, read and read some more - ask questions if you get stuck and someone can help you out. You'll see lots of threads like your own here - keep reading you'll soon feel at ease here and know that answers are here to help you deal with this stuff.

 

ALSO - AS EVERYONE ELSE SAID HERE - DON'T TALK TO THIS COMPANY ON THE PHONE - AND SEND ALL LETTERS BY RECORDED DELIVERY IT COSTS £1 TO POST - THIS WAY IF THEY LOSE YOUR LETTER - IT'S TOUGH ON THEM - you have proof you posted it.

Use Letter N in here to request CCA - there are other leters in the template library for SAR etc.. too
