    • I understand what you mean. But consider that part of the problem, and the frustration of those trying to help, is the way that questions are asked without context and without straight facts. A lot of effort was wasted discussing as a consumer issue before it was mentioned that the property was BTL. I don't think we have your history with this property. Were you the freehold owner prior to this split? Did you buy the leasehold of one half? From a family member? How was that funded (earlier loan?). How long ago was it split? Have either of the leasehold halves changed hands since? I'm wondering if the split and the leashold/freehold arrangements were set up in a way that was OK when everyone was everyone was connected. But a way that makes the leasehold virtually unsaleable to an unrelated party.
    • quite honestly id email shiply CEO with that crime ref number and state you will be taking this to court, for the full sum of your losses, if it is not resolved ASAP. should that be necessary then i WILL be naming Shiply as the defendant. this can be avoided should the information upon whom the courier was and their current new company contact details, as the present is simply LONDON VIRTUAL OFFICES  is a company registered there and there's a bunch of other invisible companies so clearly just a mail address

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

I have an overdraft on my Barclays personal bank account and have noticed that for a few years I have been paying a monthly overdraft protection insurance, which i don't recall ever asking for or signing anything.

 

How should i confront Barclays about this?

You probably never asked or signed anything for this overdraft protection insurance:rolleyes: they probably just applied it.:mad:

 

I would write to them, stating that it has just come to your attention and you would like an explanation regarding this insurance. You would also request that they send you a copy of the agreement that you signed accepting this facility:razz:

 

I am after a certain bank for monthly service fees that I never asked for or agreed too. They cannot provide any evidence that I asked or signed anything. No agreement, no certificates of destruction, nothing:D

 

I would also add up all of the little charges over the years and ask for them back with interest:D

 

Are you still using the account, if you do decide to challange them regarding this it might be an idea to open up another account, just in case

Hi

I've had an overdraft with Barclays for a couple of years and have just realised they have been charging me for PPI on the overdraft each month that i am overdrawn.

 

I am self-employed and never take out PPI, plus I never signed anything to say i wanted the PPI.

 

Should I just write in to Barclays and demand the PPI money they have taken is paid back?

I had ODI on my Barclays account, but I actually claimed on it when I was laid off. They made all the payments as per the policy but as soon as I found another job and informed them they terminated my account and demanded I repay my OD or else.

 

Slightly different to your problem, but in answer to your question yes write to them and demand they repay it immediately as it wasn't suitable for your needs and they should have never of added it to your account.

 

So make sure you have another account as backup as they will most likely terminate your account.

 

I have heard alot of storys lately about Barclays and their insurance. If you demand it back or make a claim the first chance they get they will shoot you.

 

They will write back with some b*llocks about you should have informed them earlier, but keep at them and they will refund it.

Hi Citybloke

I want to claim back Additions fees and o/d protection too - just beginning the process. It goes so far back the cost of both must be 000s. I didn't request either, tried to cancel the account and was persuaded not to. Never told o/d protection was optional. I'll keep you posted.

They have finally taken notice of me and passed this onto their investigations department as I got fed up with their it's not our fault but your fault attitude and went and complained to FOS.

 

Surprising how they sit up and take notice then.

Had a letter from Barclays out of the blue saying they had upheld my complaint and were refunding all overdraft PPI premiums plus 8% stautory insterest, but only as a gesture of goodwill and the complaint is now closed.

 

Am I entitled to claim the interest on all the PPI premiums also?...the overdraft is 19.9% per APR.

 

If i am entitled to the 19.9% also, as i have been paying it each month on the ppi premiums they took, can i still write to them even though they say the case is now closed and go to FOS if i don't agree with what they have said.

The short answer to your question is yes you can.

 

In my personal experience it would be a complete waste of time and I suggest you refer this matter to the FOS straight away, if that is the route you want to go.

 

Obviously, this is just an opinion and the decision has to be yours.

Thanks for the response. I would much rather request the money from Barclays rather than go the the FOS.

 

I just wasn't sure where i stood as Barclays said the case is now closed.

 

They just paid the refund + 8% into my account without me having to sign anything, so I have certainly not agreed to this being a final settlement.

 

The amount they owe me for the 19.9% they added each month is more than they have paid me so far.

 

I will do the calculations and send a letter to them.

If Barclays have said the case is closed, then to be honest it will be a complete waste of time writing to them again in my opinion. I personally tried this and they came back with we gave you our final decision some time ago.......

 

So afraid it is either complain to FOS or accept what they have refunded and let the rest go.

Hi....just recently got this part resolved, where they refunded all overdraft PPI payments without accepting they had done anything wrong!

 

No signed agreement and NO record of any verbal request....they know they did wrong.

 

I'm after all the interest they charged me, but they are saying I need to raise a seperate request for this, so I will now tackle this.

 

What is your situation?

If this is for current account overdraft charges, sadly the door is now closed on these unless you are claiming under the hardship rules.

 

If this is for protection insurance then I'd ask your question in a new thread in the PPI forum.
