Apparently letter has been received by Natwest ( checked royal mail website ) .

Do you guys print out an online confirmation of the letter being received ?

You can do that on the Royal mail site but you have to wait up to 5 days ...?

 

I imagine the recorded slip is enough ?

OK so back from a lovely relaxing holiday in Egypt today, only to find a letter from Natwest saying that they are investigating etc. etc.

 

So I suppose its the L.B.A now then ..letter to go out on monday !!

Allright!! My lBA still was sent recorded mail on the 8th of May...still no reply from Natwest..it is now the 25th well over the alloted time given for a response..so i am preparing my claim on the Moneyclaim web site.

Has anyone got any idea whether the banks are more prepared to make a defense since the latest (district) court ruling? Has anyone met more than ususal "resistance" from the banks?!

Thanks for that Micky you were right....the question sort of was regarding the latest district ruling..whether banks were now more likely to put up a defence?

 

Anyway, another question here....I have now saved the claim online..and this is the particulars can anyone tell me if this is ok to go? :)

 

 

The Claimant has an account 16214307 with

the Defendant,opened in 1996.

2. Between 14/02/2001 and 08/03/2006 the

Defendant debited numerous charges from the

Claimant’s account.

3.Defendant is aware of all details as a

list of charges has already been supplied.

Another copy will be sent.

4. The charges are an unfair penalty under

the Unfair Terms in Consumer Contracts

Regulations 1999, because they are a

disproportionately high sum in compensation

compared to the cost of the purported

breach.

5. Under the law of penalties, the charges

are an unlawful ‘extravagant’ penalty.

6.The claimant claims interest under section

69 of the County Courts Act 1984 at the rate

of 8% a year from 14/02/2001 to 25/05/2007

of £ 3070;- and also interest at the same

rate up to the date of judgment or earlier

payment at a daily rate of 0.021%.7.The

Claimant asks the court to enter judgment in

their favour for £3,070 plus interest,

totaling £3,721.79.

 

I'm not totally sure about the interest bit.....

Ok Notice of Issue letter has come through post

 

"in the Northampton ( why?) County Court"

 

Natwest have until 18th of June to Reply......

 

I thought MCOL was supposed to attribute a LOCAL court?! I know they probably won't defend...but if it gets to that I will have to go all the way to Northampton. Hmmmm.....

 

Any comments on that?

As soon as Nat West submit their defense then MCOL will move your claim to your local court.

reading your MCOL text again (after giving it the nod at the time :rolleyes:) it looks like you put your main charges in where the amount of interest you were claiming should possibly go? Then the interest appears at the end?

 

I'm not familiar with the MCOL template as I went with N1, I doubt it matters as it's clear what's being claimed, perhaps one of the people that know stuff will confirm that

So my claim was deemd served on the 4th of June.Natwest has until the 18th of June to reply,which is monday;and so Far not a word, not a whisper from them not even the dreaded pack from Cobbets.

So will i get something at the last minute? Any guesses?

Well this is now Saturday, and still nothing at all.Hmmm.Begining to feel a bit nervous about this! This means that their answer HAS to be there by Monday! Can they respond straight to the court and then send me a letter ? It all seems a bit last minute but I guess at the moment they must be totally swamped.

But one thing is clear, if there is still nothing by monday I will ask for a judgment online!

they're 'allowed' to get it in late

 

there's stuff somewhere about asking for judgement too early. ie before they get their defence in late, sorry to be vague, I think it was best o wait a few days after the deadline, I think

Don't do anything until Tuesday. The courts will allow them an extra day because the 18th is a Monday. Let us know if they haven't posted their defense by Tuesday.Good luck.

OK so it wasn't Monday either...What i want to know is has anyone else had this experience with Nasty West?! It seems that everyone is receiving defences etc. but not me?

 

Obviously if there is nothing in the post tomorrow then, I guess I will ask the judge to pass judgment but still it seems weird ?
