      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi im confused.

 

I have received a copy of Lloyds Defence no court date mentioned on letter.

 

Do I have to send a bundle now. Is it mandantry to do this as I thought the court would have sent me forms to complete or will they use the initial statement made with the claim.

 

Please help very confused.

 

Also on the bundle there is the peter mcnamara thing which says to include should I just print off the whole page or should I copy and paste it to word document then print.

 

Any advice would be gratefully received

So far I have got together my list of charges, have created a spreadsheet of these charges. Got all correspondence between myself and Lloyds but not sure what else should be included. Big thanks for any help.

I have a letter in which Martin Orton states that Lloyds' charges exist - "in order that we can recoup our costs". This was in response to a direct request to justify their charges, and no mention was made in the letter of them being any sort of "service charge". Please PM me with either your address or your e-mail address and I will post/send this to you to include in your bundles.

Hi

No need for the Court bundle yet, wait to hear from the Court. You should get a Court date and on that letter will be when you need to submit your bundle.

Thread one tells you what is needed, but yes i think I got a bit confused because in addintion I would have thought a copy of your POC, defendants defence, copy of AQ everything related to your claim, anyway I have stuck a copy of everything in it and they will have it by now so it's to late to worry. when is your hearing

Hello, I have just received a an order from the court that the case is to be transfered to the mercantile and commercial registry at the Royal Courts of Justice what does this mean for my claim?

No, not for a prelim - you don't need a bundle.

Sorry to post on this thread, but couldn't think how else to get your attention?

Firstly, did you get my PM about the info I have, I think it could be quite telling?

Secondly, my claim is now in full swing. Recieved acknowledgement of service and intent to defend.

Guess it's now wait for the defence and possibly an AQ.

All due within next 14 days.

Do I post info regards Litigation in Process to someone ?

Hi there

 

I am using the Witness Statement in my court hearing. Is it important that it is placed in a particular order in the bundle? If so, where should it go? I have the same problem with the McNamara transcript and, when I receive it, the Martin Orton letter.

Hi Gary,

 

Thankyou for all your advice. However just to let you know I never ended up filing an amendment as i have been so busy at work etc but was going to get round to it when as i said to you i received an order that my case had been read through and transfered to the mercantile and commercial registry at the Royal Courts of Justice. I don't know if this was Leeds or not as it does not say.

I am just checking about this 'bundle' business. Do I have to send the bundle to MCOL and Lloyds TSB solicitors. I have a court date of 1st June 2007.

You need to send it to your local Court where you got the Court date letter from and a copy to the Solicitors, do NOT send it to MCOL.

Hi Gary,

 

I'm under pressure to get my bundle submitted by next Friday so excuse me if my brain is not functioning too well.

 

I read your post about the OFT summary and am now worried about what to include.

 

You say "No need to print out the whole thing, but you do need the front cover, section 1 "overview" and most importantly, section 4.21 "Disguised penalties". You should put this in INSTEAD of the OFT report summary from the Basic Bundle in the templates library.

 

My case is against Barclays and I have used the summary from the basic bundle.

 

Does your advice only apply to Lloyds claimants or should I replace it as well?

 

THe AQ has been dispensed with and I have a hearing date. I must submit copies of all the documents I intend to rely on but I'm confused as to whether I need to produce a Statement of Evidence. It hasn't been asked for specifically.

 

Hope you can clarify.

Hi John,

 

Not essential I don't think - Barclays don't specifically defend on the basis that the charges are a service - but its still useful to include. Just add section 4.21 alongside the summary.

 

No need for a statement of evidence, but it would be advisable to include a witness statement. Use the one in this thread amended to suit.
