Hi there, been reading the forums for a while now and have decided that now is the time to finally try and get back the charges levied on me for bounced direct debits etc....

 

I do have a couple of questions first that I'm hoping someone can help me with:

 

Firstly the account in question was initially mine, then my partner (now ex) moved in and their name was added to the account. We then broke up and their name was removed from the account. What I'd like to know is if some of the charges were incurred during the period their name was on the account do I need their permission/signature to pursue this? We are not in any contact and it needs to stay that way for various reasons.

 

Secondly, I would say approximately the last 5 years I have been charged but not one letter has ever been sent informing me of these charges. Is this normal (it's a basic account)?

 

Thirdly, has anyone else had any problems with the 1st falling on a weekend, wages go in on a Friday but apparently they remove debit items before they apply credit items and all this was done on a Friday??? As I was told by my bank that this was how they did things, and hence why I had been charged exorbitant amounts of money!

 

I have had a look through the forums and couldn't find info on some of this, but apologies if I've missed the threads. I've read so many of them, they're all kind of merging!

I don't think so, but Nattie will confirm.

They normally send something that looks like a statement called 'pre-advice of charges'. Easy to look at and not realise that it's not the normal bank statement!!!

Thanks Hedgie, never ever had a pre-advice of charges. In fact I've queried with them several times why they'd charged me without notifying me and they denied ever NOT sending a letter. Maybe I have an alter-ego in an alternate reality who's receiving those?! lol

Or maybe they're just being 'tricky' with you! Don't worry posie, at least you know now that you can claim it all back - count the days till the cheque arrives!!!! Nattie should be along soon too to give you a few tips on the other bits. He works for Nat West but he's deffo a good guy - I never would've started my claim in the first place if it hadn't have been for his encouragement!!!! Sorry folks, one more question before I give in to the sleep monster. I have two natwest basic bank accounts. I understand that natwest may get shirty n close my account. Are they likely to do this to both accounts? I am only claiming back charges on the one. Just so I know whether I really need a parachute account.

Open a parachute account anyway,bacause they will try to make your terms and conditions alot tighter. Nat West as far as we can tell are not closing accounts. The financial ombusmen are fining banks that close accounts. As far as the name situation i am not totally sure but you should have no problem. The letter situation is another ploy by Nat West. They send the first letter and thats your lot. Loads of help available here . Good luck

Good luck Posiepain - I'd definately get a parachute account opened just in case,they don't seem to be closing accounts but they can become a bit shirty depending on the circumstances:D

NatWest : £857.00 won! March/07

Natwest : Witholding my statements & adding defaults etc , S.A.R sent Jan/08

Natwest for my partner : £2,101.00 won! Feb/07

Studio Cards : Refund for admin charges £108 Won! Dec/07

Complaint made to FOS for P.P.I Jan/08

Nationwide: S.A.R - (Subject Access Request) sent for statements Nov/07 ( waiting to see what happens in the OFT test case )

Littlewoods : defaulted on CCA request Feb/07

DCA's that crawled out from the woodwork and have crawled back : 28 so far!!

Sorry, i was catching up on some of the advice given and one is not amused by some of the stuff on here but your thread is fine. Question 1 hedgey is right, question 2 hedgey is right to a degree except that when RBS took over natwest they stopped sending an advice every time a DD/SO/Cheque was returned in favour of a on advice on that charge to tell you the bank will simply bounce it regardless.

on 3 nope if the 1st is at the weekend and DD/SO/cheques due out over the weekend there should be no problem, staff get paid sometimes on the Friday when payday falls on the weekend for exactly that reason .

So I stalled for a bit because of uni exams and I didn't send the SAR off. But today I printed it out, got to wait til Fri so I can get a postal order and then I intend to send it out recorded delivery. I've decided to claim on both bank accounts with Natwest, bit nervous about some news reports I've heard where the banks are starting to challenge the whole claim thing? Anyone want to settle my nerves please! :(

some people are struggling with claims for contractual interest and pre six years claims

 

the basic claim for charged and interest incurred by charges is rock solid, follow the correct procedure recommended by this site and you will be paid

Probably a stupid question, but I have a basic bank account which is the one that I'm making the claim upon, so to my knowledge I don't have any interest charges to claim? Does that sound right? :confused:
