    • Oh, one other thing. It may sound a silly question, but as they say - silly questions are better than silly mistakes. The correspondence address in the current case and the previous one is correct and current. I've never actually written to the banks to confirm my address, as is regularly advised, because I presumed if Moriarty/IDR/J&P are using that address, there would be no need to. So because both cases seem to have my address correct, should I still write to the bank or take it that there's no need in this instance?

    • Hi all Just coming back to this Forum, as it helped me so much a few years back with ADCB/Moriarty. So I've had the circulars from IDR chasing Emirates NBD debt. They've been on and off over past few years, seem to be a run of letters, emails SMS and then go quiet, then start again.   A few months ago, same started with J&P, just a basic letter, email, sms asking to get in contact. Then last week I saw an email from Emirates NBD saying J&P were acting on their behalf. Up to this point, the main thrust of the letter seems to be please contact us, or contact ENBD about payment. Then I received a letter - I can't scan/upload it at this time but I will as soon as I can - which appears to be similar to what I've seen on other threads. Namely giving bank details of ENBD, saying they've been "instructed to pursue action", and saying they've enclosed a copy of Information Sheet, Reply Form in compliance of Pre-Action Protocol They state I have 30 days from date on letter to reply, and "if you fail to do so our client may have no option but to pursue further action against you". I'm of the view, as per advice on other threads and my experience with the other lender/company, to reply as per thread #5 in the main thread. On the basis that I wouldn't wish to give them ammunition by not replying or missing the opportunity. I'm aware that on some threads, in similar situation, one poster had been advised by sols not to reply and apparently J&P didn't progress from there, other than sending same requests. I feel these things are always down to the individual's choice, and I'm keen to see what others may have done/may be doing so will actively read other threads also.   Please feel free to ask if I can help with anything, or share any opinions, and in the meantime I'll get the uploads done ASAP.   Thanks again for everyone's help in the past, and hopefully the future, and good luck to all

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I don't think it would be viewed as wasting court time - you weren't to know that they would comply, however unintentionally! However I'm not sure what the options are about cancelling a case that's been filed via an NI - can anyone help sallysas out here?

 

I filed for Pre-Action Disclosure, using an N244 Application Notice and I believe the options there are that I can have the hearing cancelled, or let it go ahead and use it to inform the court that the defendant has complied and apply for my costs (you can claim as a litigant-in-person in these hearings) - I'm still researching my options on this, but I better get a move on because the hearing is set for about 3 weeks time!

 

My guess would be that, since the court have returned the N1 to you for correction, proceedings haven't begun yet; so it souldn't be to much of an issue to stop it - but do take advice. I'd suggest giving court a ring as a first step.

Update

Tuesday 16th October 2007

 

Email from Halifax Legal Dept. today, to confirm their request for me to vacate the planned Pre-Action Disclosure hearing. In consideration of this, they are going to pay my estimated costs of approx. £250. Not bad, seeing as how they complied anyway! But I knew that they would rather that, than have to get agents out to court and risk having to explain their true charging structure to a judge ;)

 

They have even dragged their heels on getting this part sorted, hence my insistence on having it in writing (even though it is 'without prejudice') before cancelling the hearing.

 

The encouraging thing about this is that it shows, despite the test case that they are treating as some kind of reprieve, that they are still basically frightened to death of being dragged into a court of law to justify themselves.

 

Anyway, profuse thanks and hugs to deedee and Melanie Bree for your guidance while I prepared my case; and credit to the Information Commissioners Office, whom I believe were also instrumental in getting HFX to comply with their legal obligations under the Data Protection Act 1998. Also thank you to my fellow CAG-gers for your encouragement and support. A good result in my view, although part of me would have much preferred battling it out with them in court! :D

 

Right... now to prepare the 'proper' Court case to get my charges back :roll:

Sorry I have not been around much. As you know I was moving house. It has been a nightmare with many false starts but it all finally happened last weekend so I am no longer a Londoner! :(:) .

 

I am currently holed up at home due to having come down with some bug. Yeeuuch!!

 

So round one belongs to you which is excellent news. Now we await the Battle Royale for the claim for charges. What a 'mare - all this JUST to get data that's rightfully yours to have. LOL d'ya think your charges claim will be just as protracted?!! I hope not.
