My question is the earlier managed loan?

Surely that was settled?- albeit with a now unexecuted managed loan.

I seem to remember that we would not be able to seek redress for a CCA1974 request with our £1 fee for debts that had been settled- and in effect that is what has happened.

 

The original ML started September 2003 and was consolidated into ML February 2004. I therefore feel that the original ML is now a Dodo.

 

Does anyone agree?

I think before you could possibly agree to anything you would need to see full documentation for both the earlier personal and managed loans and the managed loan which is in place now including both the loan agreements and the statements back to the year dot :).

Just a couple of thoughts on this. Firstly does your accountant know what charges are legitimate and which are the result of returns etc and secondly does the loan actually come within the CCA as until recently the limit was £15K

 

Result of returns?

I thought charges for returned cheques were reclaimable as is unpaid items & recall S/O D/D.

 

Dont know about £15k limit - loan started Feb 2004.

Yes the charges they charged you for returning items such as cheques, DD's and SO's are reclaimable, but unfortunately you really ned to get the breakdown of the total charges that HSBC have charged you in order to ascertain which are for running your business account and which are for bouncing items and going over the agreed o/d limit. If possible, ask your accountant if he/she has an analysis of the charges that HSBC have taken from you.

I will be speaking to the accountant tomorrow hopefully.

 

However as these charges are outside the six year period that HSBC maintains it only holds data for- How will they dispute anything that I should claim, if I made an error?

As long as you have proof of the charges I don't see how HSBC can dispute them. If they do dispute them, I would want to know on what grounds and if they have proof of their dispute eg they do actually have the records from way back when, I would definately ask to see this.

Exactly, and then I shall want to know why they havent supplied them with my SAR in Feb 2007, and all the susequent requests for them since.

Rumor has it that all of the banks are having to spend millions setting up specialist departments to handle the volume of bank refund claims (better late than never) so it's not surprising to see a new name crop up.

 

I wouldn't do that job no matter what they offered me :)
