It may be worth giving their customer care department as from what i have been told its completely down to their discretion wether they refund them or not.

Whenever they have refunded any of mine I have just called the 08457 404404.

Still not defended mine as of today - i'll give them till the weekend then I am hitting that judgement button.

Hi charliedog!

Wasted costs are costs you've incurred due to HSBC being unreasonable-not paying up straight away, saying they are going to defend without having the intention

Things like paper for the court bundles, postage, preparation time for the court bundles, time off work costs , which could have been avoided if HSBC had been more reasonable.

THere's a link somewhere where Lucid and mindzy applied

1ST DRAFT

Total Approximate Costs Incurred in Pursuing the Claims

1. 14 letters sent by 1st Class recorded delivery at £2 each to cover postage and stationary is £28

2. The total cost of preparing the document bundles for each claim in triplicate is £50.

- paper cost of £20 (1 box of 5 reams)

- printer ink cost of £10

- special delivery postage and packaging cost of £20

3. Time spent in preparing letters, document bundles and case notes is at least 20 hours. Total at £9.25 per hour is £185.

4. Loss of earnings in the total sum of £154.

- Mr Mindzai lost £96

- Miss Lucid lost £58

TOTAL COSTS: £417

They won this-its worth reading just to see how these banks are such barstewards and how amazing these two were in defence and for some excellent ideas for letters

Ther's more info here on wasted costs

oops -long reply

Thanks all of you and esp for the T and C's etc ...gosh getting so many to thank!! But the info is so supportive and we all have these little hurdles we need help getting over..and although we are reclaiming our rights to our money It does get scary sometimes ...don't know about you lot but sometimes I wonder at what point HSBC will actually turn up and go the full way to court...nightmare situation!! :o

Nighmare for them if they did! Imagine a court case going against them? I read somewhere that it's something like 22 billion pounds they have taken in charges over the last 10 years. They will not want the flood gates opening any wider than they are now. You will get your money!

its scary and annoying, why r dg and hsbc just delaying what both parties know is gonna happen which is 2 pay up, cos of them not playing fair my claim if i have 2 pay an AQ fee plus the charge i paid to file on mcol will go to nearly £1000, so they r costing themselves more money.

my mums with the woolwich, she rang em up and said shes not happy with the charges, woolwich said they will look into it, next day she got a letter saying they will let her know in a months time

a month later to the exact day she had a letter with a list of all her bank charges offering all of it bak which was 2.6k, simple as that.

just seems no end in sight at the mo, and seeing how easy it was for my mum makes in abit disheartening

but im taking it all the way and i wont be beaten :)

I have said all along this is a waste of money for all of the banks who fight the claims, you read the threads of people who have just started their claims and would be happy to have a sensible repayment rather than go to court and get an extra 8% but it doesnt happen.

Added to that if you look at DG's web site they quote something like £130 an hour for their time, it must be a horrendous cost to HSBC and all because they are too pig headed to sort it out quickly before people file claims with the courts.

if you look at the statistics HSBC have paid out loads more than the Woolwich as they are a bigger organisation with probably thousands of more claimants. By making it harder for us, some people settle for a lower figure or dont even claim at all. For the ones that go further they are dealing with them in some sort of date order ie. get a court date & your closer to seeing your money.

you'll get there too!!

When is your month up nima - mine is up on the 10th June had a look today but still says acknowledged - not defended yet - do I press the start button on Monday 11th June if still not defended? Also had no further paperwork from courts does that happen when the 10th June arrives i.e. notice of transfer etc ......DG won't even contact me by e mail to say they have my paperwork but they must have because they have ticked the box to defend?

Hi fellow joggers!

Don't understand why I have had my defence from MCOL before you lot considering Nima is 3 days ahead of me in submitting her MCOL which means that either MCOL have had a defence for Nima but not showed this online or that DG aren't working to strict order of submission unless some of their solicitors are quicker at getting through their cases-mine is Kate Eaves.

Charliedog-I went overdrawn beginning of month and got a phonecall yesterday from India which was accepting my request for an informal overdraft although I hadn't requested.I was ready for a battle on the phone but she was quite helpful after I told her there was a court action against HSBC!

I think its time for me to open my own thread now!

Hi Wolfie - well that happened to me - the informal request I didn't request - thingy - but no phonecall just a letter saying - been considered and ok we'll charge you £100 for thinking about it - my salary went in 2 days after less £100 for HSBC having a think!! My contact [?] is Kate Eaves too - but no matter how I try to they don't communcate back to say they've had everything - and they have to defend by 10th June!!

Nima is a he ...just for info !! I'm a she :p

It makes me worry that perhaps I've done something wrong on the SOC and they are not gonna tell me or ask me about it till it gets to court - I worry too much I think !!:roll:Freaky is right - have u got a thread we can find u at?

All you want to hear from DG is an offer... and they will make one... for the time being silence is good...

Trust me if they had found any mistakes they would have told you, I doubt they have even looked at your schedule yet if they ever will, they are lawyers seconded to a bank not accountants (bankers), they think Uncle Colin and his drones have checked the figures but there is no proof Leeds and Brum actualy talk to each other so as long as you have nothing over 6 years you will be paid.

My MCOL finally changed to defence.

Was giving them til after the weekend as well.

Oh well, i'll just sit tight and wait for their standard defence to drop through my door.

It feels never ending but i'm finally getting closer to settlement with one of my lloyds accounts now so its all well worth it.

Golly gosh - has Kate Eaves got a ear on this website? - Received today at 07.41am [can't she sleep!!] e mail - very formal saying that she has received e mail [doesn't say which one tho?] and will respond in due course. Advise that claims are dealt with strictly in order of receipt..Now that is total B...ks!! We all know when we sent them and we know some get answered earlier than others !! Just got to check MCOL now as date was up today.....:|
