hello,

 

i have sent letter to RBS to claim penalty charges totalling £3,063.25

(wich include interest amount of £1,262.25).

 

I am based in scotland.

 

i have heard that small claims amount limit in Scotland court are £750.

 

in case i have to go to court, how do i proceed ? do i have to open 5 claims ?

Any help/advise.comments welcome please.

What is a summary cause?

 

A summary cause is a type of court procedure. You do not need to use a solicitor, but you can if you wish. If it relates to payment of money, it is used where the value of the claim is over £750 and up to (and including) £1500. A summary cause can only be raised in the sheriff courts.

Can anyone help me. A friend of mine has put a claim in to Royal Bank of Scotland along with his wife. His wife has had her charges refunded in full without having to do an online claim. But her husband has done the online money claim quite a while back, and has had to pay a further £100. He has just received a letter saying that Royal Bank of Scotland are taking HIM to court on 8th June to defend his claim. Do you think it will actually go to court? Have you heard of this happening before?

this kind of thing happens quite a lot. \I would not worry about it. I would say to them that you look forward to meeting their representatives in court telling the judge how these charges are justified and the breakdown of the costsetc.
