HI

 

I have just read on another post regarding a bank stateing that the fact a charge occured from having insuffiecnent funds to cover d.debit cheques that werent able to clear etc, is the fault and responsability of the person holding the account.

 

Does anyone know if this holds up in court, as it sounds to me it would do.

 

I have started a claim, no date yet, but I am worried that the bank will try this as their defence.

 

would appreciate any suggest or info

It is correct that it may be your fault, but the claim is nothing to do with whose fault it is - indeed you are actually admitting that you have breached your contract with the bank.

 

What the bank are not allowed to do is charge you more than it costs them in rufusing payment. The law says that where a party breaches a contract, the other party can only recover its actual costs.
