Sorry, I understand you may be slightly worried that I say I have read through the posts to find certain information etc. and yet I say I cant find somethin relevant to my question Please dont take this personally, yet you could try and make something good out of my post. If a dyslexic person was trying to claim back charges taken from them, and made it clear to you that they were dyslexic, would 'The bank action group Mods 'be so hasty into stating that the Faqs have not been read, all the time, that when a question has been asked by someone and a mod doesnt fancie answering it because it is all in the Faqs, threads etc Maybe there are some people who do suffer from Dyslexia who are members of this site trying to claim back charges. and now feel that they wont bother! because it is all written down in the Faqs, threads etc, etc...... Please Feel free to remove post as this was not meant to be a hijack of a thread
  9. Hi I have read throught his thread and am interested but just a little confused on llegal part of claiming 16% interest instead of the initial 8%. I am helping my boyfriend with his claim and we are now making a claim to the courts as the bank in question have not paid up!. I have calculated the 8% interest accordingly, But am still interested about claiming the 16% I might sound greedy, but its not about being greedy its just about claiming what I am owed. The banks etc, do not have any leway when it comes to charging us, t&cs etc. So if we are llegally alowed to claim 16% interest then we should go for it, as many people that have now been paid, have lost out on the extra claim of Interest and the fianancial institutes know it, But are keeping very Quiet........ I have read the whole thread through and did not see anything about any legal status regarding this increase in interest. Would it be laughed out of court and do you have any solid docs where I can quote on my particulars as I cant seem to find anything on act 's69' etc Appreciate any suggests or help Anita

  11. Hi I have read through some threads about the interest you can applie to your claim when going to court. Can someone clarify that you apply the interest onto the 'unlawful' charges untill it has been paid. ie. charge was made on the 15th june, and was taken from your bank account on the 30th june. So you apply the interest for them 15 days..... Or Can you claim interest per charge, per year? Sorry if the answer is already posted. Thanks inadvance

  13. I understand this, it just makes you feel when you are running after people that you want more back. Unless I did put this claim in originally, it was a long shot to add it now, but I would of liked to of been able to Well it is a case of just waiting then for the account to be credited. But they have been stalling all week and somehow it seems that it would bennefit them. Can a mod close this thread please. Thanks for your advice after the misunderstandings. We got there in the end. Once the money is in the account 270 up and just a loss of interest. Thanks again for your help.
  14. I had to go to my local branch where another form had been faxed over so I could sign it, and then the form was to be internally faxed back to the customer relations dept This took all day, from 10.30am till 3pm
  15. I have had the letter written to hand into the court from Monday this week to stop the proceedings, But couldnt hand it in, because they hadnt paid the full agreed amount into my account. I didnt want to risk stopping the claim untill the settlement had been fulfilled. It all seemed like I was losing out, even though the remaining amount of the settlement been credited to my account a little while ago, From what i had been told about 40 mins ago. But it still isnt showing in my account I just think all the hassle I have had with the halifax this week has caused more problems, then the original plan to attend court to re-claim the refund
  16. Thanks, I thought I was going mad. I wasnt after the 20 pounds that the offer was short of. They had only paid a small amount of the agreed settlement. When I say I have been running around all week trying to find out why so many co*k ups had been made regarding the remaining amount and the form. I mean it, I havnt stopped phoneing them, because they have been stalling with me.. So what I wanted to do was, If Poss was to retract the acceptance forms and take halifax for the remaing amount to court. On my Original claim, But just to amend the amount I was claiming for. And because I am highly P***** off I wanted to try and claim the interest I had not originally included + costs incurred during this whole process. While they still sit on thier backsides acting as if they are doing favours for people
  17. My english is crap my claim was for 290, they offered me 270 -( 20 short ) They sent me two acceptance forms for this amount. One acceptance form they lost and one form, for the lesser amount they credited my account with. After i told them I needed the whole amount to be credited to my account not Just part of the agreed offer of settlement I have waited all week for them to credit my account with remaing amount of the agreed settlement. Because I was fed up off running around all week after them. I wanted to carry on with my claim and refuse the agreed offer of settlement. I had not stopped my claim, Because they had not paid the whole agreed amount into my account. Does anyone understand me :?
  18. The halifax has now phoned me and told me the remaining amount has been credited to my account. The main problem was signing the form and them playing god with my money while I am phoneing them, running down to the branch. Bloody Ridiculas!!! Sorry for not making my posts clear I will wait till the money has been made available. But with all the problems I have had all week, I would of preferred going to court and fighting it out there if it came to it. Halifax Plc are a Disgrace! to be recognised as a trustworthy Fianancial institiute
  19. Ok 1 - This offer was agreed over the telephone. Halifax has Not achknowledged my claim. 2- I agreed to the offer even though it was 20 short from my original request. 3 - They have paid part of this agreed settlement into my bank account, against my verbal consent!!. They have a signed! acceptance form from me for this to be credited. 4 - They have not paid the remaining amount into my bank account , which was promised at the beggining of this week. 5 - When they do decide to credit me with the remaining amount I want to refuse it because I have been running around like a blue a*s fly all week trying to get this sorted out and dont think I should be doing this, even now i am still awaiting a phone call from halifax I needed to amend the claim to deduct the amount they have paid me. Because I forgot to add interest I wanted to apply to add this on to the amendmant
  20. Hi I understand 100% what you stress about reading the Faq's and I can tell you I havnt messed up my case Yet!! Ok I have not Stopped my claim, If they do not achknowledge the claim by the 14 June they would have defaulted The only forms I have signed is two acceptance forms for settlement -20 short of my full refund. They have ignored my request to, Only Credit the whole amount, to my account. Even though I did state to them that I was NOT going to stop the claim untill I recieved the whole settlement into my account They have credited part of the settlement, hence -one acceptance form that they did have, I did stress to them I was refusing for them to this So with part settlement in m yacc, I have been waiting all week for them to credit my account the remaining amount, and they are claiming there has been errors. and that it will show up tomorrow on my account, but Obviously not available to cash out, untill it clears. Probably Mon or Tue. The original offer was agreed on the 2nd June. If you read my long winded post on thier C**k ups you will see that they origianlly lost the acceptace form etc. Other than carrying on with my claim, I need to amend my claim, for the amount. I am been toild that I cant and then I can. Feel a little stuck
  21. Thanks Imactually waiting for the halifax seinier L. to phone me back. Stalling isnt the word. The only problem is I was told by the county court I can not ammend my claim, in the amount im asking for, as I didnt include interest, want to get all my phone calls back ! But I have to now as they have already paid some money into my account. Do you or anyone know where I stand llegally in regards to signing the acceptance form and then retracting it?   23. Hi Halifax have made me an offer to settle, 20 short of original request, you might remember my thread. Well they have made more cock ups in the last week then I can imagin and I need some advice. Basically, the acceptance forms were sent and recieved on Mon,this week. But one of the forms had gone missing .... This form was for the most of the settlement, , convieniant!!! I told them that I could NOT accept part payment, Either I have the whole amount cerdited to my account or nothing at all. !!!!This was ignored!!!! Part payment went into my account yesturday without my permission, though I did the sign the acceptance form for this amount. I went into my local branch again yesturday to sign and internally fax over another acceptance form for the rest of the amount. This was to be credited straight away into my account. They have given 28 pound extra for inconvieniance on the other accepatnce form I gave it A couple of hours, And yet still it wasnt there or even showing as a transaction I have phoned the customer relation manager who was dealing with the settlement, this morning and she has told me that the person who was meant of credited the account has made an error and hasnt done it. She has now told me that It will be done today but will not 'show up' untill tomorrow !! Normally you have to wait till after the weekend for credits to show up as available. The other thing is on June 14th they would have defaulted on the claim that I have made againgst them, as they have not even achknowleged the claim I actually want to stop this settlement going through and take it to the court as I have been running around all week, due to their mistakes and I am still not bennefiting, Well 28 for my inconvieniance !! I was told through telephone banking that when a crdit has been made from the halifx into someone 's account, it gets credited and made avail straight away. So what is really the hold up??? Does anyone know if I can stop the settlement going through and carry on with my cliam Or is it too late??? Need some advice ASAP as they are phoning me in 20 mins !!!!!! Thanks in advance

  25. Thanks Sometimes when I explaine things I think I go into too much, without the acutal points and questions. Monday I will send the Sar form with the 10 Fee. When I recieve the info and calculate the charges. Would it be better that I go to Fianancial ombundsman service or re-send the Lba. I have recieved a letter explaning why the charges were placed on my account, and apparantly they are Not willing to reply again to my complaint. Thats why, Im not sure on the next step, what would bennefit me the most. If I re-send the Prem letter, then the Lba, They will not reply again... Just not too sure on how to handle this one Abbey are also NOT taking Responsabilitie for the debt that was passed on to the debt collection agency Any suggests ?
