can someone please help i have 2 accounts with LTSB i have wrote too them seperately for each account trying too get bank charges back. i am now about too go on 'money claim' to file a form N1 will i have two file two of these forms or will i be able to combine them?:confused:

You can combine them in 1 claim as long as they total lessthan £5000, they're both in your name and are personal a/c's

There are 2 instances of interest you can claim:

 

1.When you go overdrawn the bank will charge you interest, perfectly lawfully.

 

However, if part of your overdraft is made up of penalty fees, they are also charging you interest on these too and it is this interest which you are entitled to claim back, but it's tricky to separate out from the total interest figure.

 

Vampiress has a spreadsheet, (the advanced one), in the bank templates library, which attempts to calculate this

 

It's quite complex and unless your claim is large may not amount to that much, so for simplicity's sake, some people don't bother

 

This is the interest referred to in the preliminary and LBA letters.

 

2. Section 69 8% interest on your claim, but only when you submit a claim at court. Don't add this interest before moneyclaim

 

 

but on the form N1 it asks for overdraft interest

But only if your claiming it. It's not compulsory

hi everyone abit new to this i read quite afew of your threads before going to moneyclaim. must admit found it hard going must of been on the site for a good 3-4 hours!! its done now hopefully done properly!! can anyone tell me the next step is it sending schedule of charges to court?:-?

Yes, you should do the following:

 

Send 2 copies of your schedule of charges, clearly marked with your claim no. + a brief covering letter asking for them to be filed with your claim to:

The Court Manager,

Money Claim Online

Northampton County Court

21-27 St. Katharine's Street

Northampton

NN1 2LH

Dear Sir/Madam

(Your Name) –v- (Bank)

Claim No: ********

Date Issued: xx/xx/xx

Please find enclosed a schedule of penalty charges taken from me by the defendant, along with interest claimed at the annual rate of 8% pursuant to section 69 of the County Court Act. The interest in addition to the amount in charges equates to the total amount of my claim, namely £(AMOUNT).

I respectfully request that the enclosed schedule should be attached to the particulars of my claim.

Yours Faithfully

 

 

 

And when LTSB acknowledge, send a copy of your schedule to the Solicitors.

Some has just phoned me from my local branch. Saying because i have been banking with them for a long time i am now classed as a premier account holder!! and she would like to meet me!! i didn't really know what to say,:o itold her i had just filed a court claim against them and i intend to close my account with them in April due to their increasing bank charges what a conversation stopper!! she said she was very sorry and said good bye!!

not sure if i said the right thing!!

When you receive the Notice of Acknowledgement (not the Notice of Issue) from the court and then send a copy to the bank’s solicitors, since they are the ones who will now be dealing with your claim

 

Dear Sir,

Please find enclosed a copy of my schedule of charges relating to the above claim.

hi, i was wandering if anyone had their claim from the court 'deemed to be served on the 3rd march to LTSB. I got a acknowdgment of service around the 7th march that they intend to defend!!!, i sent SC&M my schedule of charges and haven't heard a dicky bird since:( i know they've got till the 31st march to enter a defents but i was wondering if someone had done it the same day as me has heard anything:)

i'm just impatient thats my problem!!!!

SORRY!!! Just had my N149 AQ through got to be back on the 7th April, just afew questions;as the form got to be hand written!! i've copied the templates for the QA so i know what to put! when i wrote to the court (money claim) with my schedule of penalty charges i didn't add the £80.00 fee i had to pay to file a claim against LTSB would this matter:confused: will i still be able to claim this back?
