    • Any update here?  I ask as we have others now taking on CPM.
    • I am sorry about getting your status mixed up.  I have noticed one thing in your excellent WS. On their claim they are only pursuing you as the keeper-I think it is  in their Point C that  states along the lines of -the driver did not pay , so the keeper is liable. So on your No keeper Liability section  You may prefer  to alter 13 to    . It is trite Law that the driver and the keeper cannot be regarded  as the same person and the claimant has failed to offer any proof who was driving.  BY  only pursuing the keeper  when the PCN does not comply with PoFA must mean that their claim fails. See what the Site team thinks as it should  stop the Judge from looking at who was driving as your statement preempts them from even thinking about it.
    • What would suffice as proof? I just emailed them back my date of birth. Should I send a copy of driving licence? 
    • Which Court have you received the claim from ? Northampton   MCOL Northampton N1 ? Manual Claim CCMCC (Salford) ?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all, Firstly can I say a big thank you to all on the forum. The advice contained here is excellent and I am now extremely confident about recouping my "charges" from Bos. I have completed step one (by going into the bank and asking for my statements. These were recieved within 6 days, without paying for them!!). I telephoned the bank on monday (yesterday) and the chap on the phone said that when you order statements from your own brach, a different process is involved and that was why it was faster.

Anyway, I wondered if anyone could give me the FULL address to send my preliminary approach for repayment. Some have suggested sending it to Leeds and some have suggested Edinburgh.

Any help would be greatly appreciated.

Hi folks, just a quick update from me.

I recieved a statement out of the blue today after sending my initial approach for payment last week. The ststement had £266 extra on it so I telephoned the bank and was told that this money was not in my account and had nothing to do with my ongoing claim however my letter had been recieved and they were looking into it. The guy on the phone was really helpful and said it would be "dealt with" within 14 days but if I hadn't heard anything in a week to phone back and i would be made an offer over the phone . He gave me the number of the deparment that deals with this sort of thing for bos so here it is incase any of you need it: 08457253519.

I will still be sticking to my timescales re: 2nd letter if I need to but it will be interesting to see what I'm "offered" lol.

I'll update you again in a week

Took me 6 weeks in all,to get an offer,so you are well ahead if they do offer so quickly.I was claiming for £4732....they rang a week after recieving LBA and offered £2000,turned it down,2 mins later after bein on hold came back and offered full amount.SETTLED.:)...Stick it out and stick with your times,They know they have to pay and will..

QUICK UPDATE:

Got the usual fob off letter on sat but will stick to timescales and send LBA this tue.

:)

(I'm going to phone on tuseday as well:D)

 

EDIT 20/03/07: Sent LBA today and also telephoned to advise bank that I was sticking to original timescales and would not be put off. Spoke to an extremely curt/cheeky representative who advised she would "update the file".

Just a quick update.

Telephoned BOS customer services today (08458501368)) and was told by a representative that they had 8 weeks to respond/investigate. When I pointed out that this was an umbrella timescale for any complaints and that I had already given them ample time, the chap on the telephone started to get ratty and said that under no circumstances would they be able to respond within my timeframe as they needed to draft in staff from other areas. I informed him that this was not my problem and an organisation such as themselves could easily sort this out within the time I had allowed them he seemed to get shirtier. He said that "standard" internet letters did not give the bank enough time to investigate. I asked what was there to investigate as it had only taken me 10 mins to look through my statements and tally them up. He said that they would endeavour to sort things out as soon as possible and keep me updated every 4 weeks (standard FSA stuff). I told him I used to work in a customer services role (4yrs) for a financial institution ( AN INSURANCE COMPANY NOT A BANK) and was well versed in the FSA guidelines, to which he replied that he didn't care.I asked him if he was aware that I would be claiming for 8% annually from the date of service for each charge and also for court costs. (o.k I was fishing a bit haha) He said yes but that was only if I won and I probably wouldn't. I asked him if he wanted me to go ahead and file the claim and he said yes if you like. I then laughed and told him that it would be cheaper for them to settle now and I would be willing to drop the case for a full refund of all charges. He said no, go ahead and file the claim. What a rude little man:evil:

I've got his name and I'm sending a written complaint letter about his attitude (poor boy must have been dealing with these all day haha)

Sounds like BOS are now trying to double bluff people into dropping their claim by taking it right to the line but theres NO way I'm backing down.

Ha ha good for them because (thanks to help found here) I know that I've done everything properly and to be honest, I could do with the 8% extra :D:roll:

I also have all my court papers ready thanks to SCOTIA's excellent guide http://www.consumeractiongroup.co.uk/forum/scotland/6165-scottish-procedure.html and I telephoned the Sheriff Court today and spoke to a lovely girl who checked the paperwork for me over the phone. (one thing she did say was to put the HEAD OFFICE address in box 3 and in the statement of claim to put in your branch and the address when you say that "XX has a branch in XX therefore it is under the jurisdiction of this court" you should give your own branch address here also) and to file against the bank all you need is form 1 and 1b.

I was going to give BOS 14 days then 2 clear working days before I filed, but now I'm not. The 14 days runs out on Tuesday and I'm filing on Wed.:D

Well done. I spoke to BOS yesterday to tell them that I had been granted default as they had ignored the court and would be going to get the forms for the baliffs today. The woman had a good moan and asked why I had gone straight to claiming after she had refused to refund the charges. Seems I should have told her that I disagreed with the refusal. What does she think the LBA is?.

Customer services supposed to be `phoning me, but nothing yet. I`m reading the leaflets about warrants of execution I picked up from the court this morning, and will submit them the next time I`m in town(Friday).

UPDATE:

Been to the court today and gave my papers to the clerk who was very, very helpful (and very very pretty:D). All I need to do now is to wait for the relevant sections to be sent back then go the the sheriffs officer and get him to serve the papers (because its a summary cause claim for 1300)

So it's back to the old waiting game again. BOS would've been better paying me the money when I gave them the chance :rolleyes:

As usual I'll keep you updated as events unfold.

EDIT: 13/04/07 recieved all papers back from the court. Been to see the sheriff officers today and they will serve the papers for me asap. Have a return date and a court date set for May.:D

Hi all, just a quick update again,

I've got a return date for nxt week and a court date for the week after, so I telephoned BOS today for an update. If they are going to defend I'll need to take the day off work and I need to book it in advance. A helpful girl went away to see if she could get an update for me and she came back and said that they were definately going to defend in court.

This has got me a little worried incase something is wrong with my claim (which I doubt very much).

Do you think this is just another timewasting ploy and its a case of them trying to stare me down again or do you think they will really defend....:confused::confused:

Cheers christinajanep, thanks for the moral support. That's what I thought. I wish I could prove they were deliberately stalling for time and I'd take them to court for that as well. The Scottish court papers say that if you intend to pay then you should do so "in good time before the return date":mad:
