And is between Moneybarn No1 Limited  and xxxxxxxxx under agreement number 756050. b)    The claimant was one of the original parties to the agreement. c)    The agreement is regulated under the Consumer Credit Act 1974. d)    The goods claimed Ford Ranger 3.2 TDCi ( 200 PS) 4x4 Wildtrack Double Cab Pickup 3200 cc (Sep2015} Registration No ^^^^^^^ Chassis number ***************** e)     Thw total price of the goods £19570 f)     The paid up sum £1206 5 g)    The unpaid balance of the total price £7505 (to include charges) h)    A default notice was sent to the defendant on 20th February 2024 by Firrst class post i)      The date when the right to demand delivery of the goods accrued 14 March 2024 j)      The amount if any claimed as an alternative to delivery of the goods 7505 22 include charges ]= 5.  A the date of service of the notice the instalments were £562.89 in arrears. 6. By reason of the Termination of the Agreement by the notice, defendant became liable to pay the sum of £7502 7. The date of maturity the agreement is 24th August 2027. 8. Further or  alternative by reasons of  the Defendant breaches of the agreement by failing to pay the said instalments, the Defendant evinced an intention no longer to be bound by the Agreement and repudiated it by the said Notice the claimant accepted that repudiation 9. By reason of such repudiation the claimant has suffered loss and damage.   Total amount payable £19570 Less sum paid or in arrears by the date of repudiation £12064 97 Balance £7505 (to include charges.) ( The claimant will give credit if necessary for the value of the vehicle if recovered.)  The claimant therefore claims 1.    An order for delivery up of the vehicle 2.    The MoneyClaim to be adjourned generally with liberty to restore,  Upon restoration of the MoneyClaim following return or loss of the vehicle. the Claimant will ensure the pre action protocol for debt claims is followed. 3.    Pursuant to s 90 (1)  of the Consumer Credit Act 1974. An order that the Claimant and/or its agents may enter any premises in which the vehicle is situated in order to recover the vehicle should it not be returned by the Defendant 4.    further or alternatively damages 5.    costs.   Statement of truth The Claimant believes that the facts stated in these Particulars of Claim are true. The Claimant understands that the proceedings for contempt of court may be brought against anyone who makes or causes to be made a false statement in the document for verified by statement of truth without an honest belief in its truth.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi guys its me, god have i been missing all of you! Brief synopsis of my last two weeks: Moved house, he didnt seem that bothered!, no computer yet so have been taking kids to library to use it there but they need to use my card so i'm stuffed! Found out that there is a third party in my relationship (and its not natwest!) and who has been not only in my house but in my BED, a whole week after i left!!! Nice eh. My gut instict tells me it has been more than a one night thing and i actually have evidence of this. Anyway, then my godmother died and i am now at my mums in the midlands using her friends computer!!! How sad is that. I have drunk too much after the funeral this morning and i feel like my hangover is kickin in now, plus i forgot my glasses and my eyes hurt from crying. Oh woe is me eh.

 

Anyway got a prelim hearing on 25th June, what do i need to prepare for this? Sorry for hijacking your thread Fendy but am on borrowed computer time at mo.

 

Need to say: A MASSIVE WELL DONE TO PARKY!! what a result!!!

Jetspark, I would simply read up on the Draft order for directions to familiarise yourself on anything you should be asking for, and I would also PM Michael Browne if I was you. Having just been through a phone conference myself and not being entirely prepared for it hun, I would hate for you to put any foot wrong. PM him, Im sure he would be happy to advise on anything you need to know prior to this.

Morning peepies, and what a gorgeous morning it is in Oakies today. Little lad nattering to put the pool up, so have spent best part of an hour nearly fainting and seeing iccle sparkles in front of my eyes through blowing up giant rubber ring around the pool edge. Its one of those Intex easy up pool thingies, a big 10ft one, and boy do I wanna sleep now, Lol Lol. Those funny sparkles appear for a reason, thats when I shoulda stopped blowing, but nope, kept going and nearly wobbled over a few times. Feel all faint and funny now.............. probs gonna take about 7 hours to fill the thing and I darent even think what my water bill will be next quarter once its full, lol lol xxxx

 

NVM, Seahorsey, off back to sea, well try and bob in when you can my friend, I know life on the waves is busy, but we do miss ya you know. Well its not the full bundle I gotta do Hedge, its just a disclosure list, which is bad enough in itself, Lol. Its way too nice today to do it, and weathers supposed to be a bit iffy here tomoz so gonna crack on with it tomoz, and at home Monday so hopefully will have it finished on Monday. Not worried, completely got it now in my head, so its just a case of sitting still long enough in one place to get it completed (and believe me, thats very hard for me), always on the go.................. ants in meee pants usually. Only had two glasses of vino last night so feeling top of the world, no hangover or anything, yaaaaaaaaaaaaaaay.

 

Archer very kindly sent me a copy of Natwest terms and conditions for a year which I need, so I got them, thank you archer you uber darlingness.......... I cant thank you enough hun. Very very grateful.......... so working on any other loose ends I need to tidy up. Got offer today, albeit paltry from Capital One, £378, Im turning it down, obviously, and then can file at court next thursday anyway. So filing MCOL again on mine and hubbys Capital one next thursday cos they aint playing ball, so neither am I. And going for contractual on both too, Lol Lol xxxx Now I know what Im doing on here, Lol xxx

 

Right off to check on how the pool is filling up......... probs end up with every kid on the street in the back garden this afternoon, once the pool becomes common knowledge, cripes I might be back on here then for some peace and solitude to escape the noise, Lol Lol xxxx

Ha! Glad I'm not the only daft woman in England putting stoopid pools up just cos it's sunny!!! Wouldn't mind - but they use all me clean towels as well when the blinkin' thing's up!!!

 

Gorgeously lovely day too here Fend - so's off to clean the house now aforementioned stoopid pool's done............. asda for some barbie bits................. then GARDEN FOR THE DAY!!!!!!!!

Too right Hedge, and dont worry about 6th July. We all completely understand. Twinkies would be gutted if you didnt go. But I do think we have to reorganise, we cant do it without ya Hedge, pointless really. So lets reorganise for another time. Right, clear head, pile of paperwork, i.e. natwest file in front of me, and raring to go on the disclosure list. Gonna take me hours, but not worried. I am so focused on this now its untrue. Not gonna start falling at hurdles this late down the race................ So thats me busy for the next few hours, got the day to myself, family scattered to the four winds today, so nothing else better to do right now, and weather cloudy but warm so what better time to start my list then now. Will be finished by tea time. Guaranteed................. then PM it to a mod to check over, and ensure its hunky dory ready to submit to judge no later than 26th June. Fends submit titas early as you want , but just make sure it is right. You will feel alot better when you have filed it at the court. Good luck.

Okies, thanks Parky. Much appreciated. Just thinking though, on the example of disclosure list in the templates, i.e the one done by karnevil thats the basis of the spready Im using, do i have to list my statements on there as evidence or not. Can I just list my charges spreadsheet, or surely I would have to list my statements, i.e. numbered 450 to 1150 etc. Sheet by sheet, or dont I have to mention them at all ??? It doesnt show these listed on the example disclosure list done by Karne. Do you know ??? or not ????

Okies, ta Parky.

 

The thing I was wondering though. From what the Bank Fodder was saying, at this stage, all I submit is the actual list. I dont enclose all the original document copies I intend to rely on at this stage, is this right ???

 

or when doing the disclosure list, do I have to photocopy everything I am submitting in the list with the list itself. I got the impression from BF that all I had to submit was purely THE LIST itself, not the actual copies of the documents. Aghghghg, help is this right ?? which is right ?? getting confused now ???
