    • Can anyone help please? A while ago I booked an apartment in France for Sunday 9th June for three nights. Today I had a message via the site that following an unspecified problem the host has to cancel our stay. I asked about a refund of what I've paid and the host indicated I need to speak to Booking.com. Booking.com have said that they won't charge me for the apartment but my understanding is that I've already paid in advance. Their website has a lot about what happens if the guest cancels but so far I haven't found anything about what happens if the host cancels. Any help would be much appreciated. HB
    • Hi Shakey, you're in a good spot being so close to SB date. Do as advised by dx, defend for sure! and make them work for it! There's no rush to settle at this stage.
    • The only option available with Money  Claim online is requesting judgement if no allocation of service  submitted. They have done that.  
    • I have received a Claim Form for a debt owed to OVO energy from 2022. Should I try and defend this claim even though it is quite recent and is it different to other debts as this is for electric and gas( I have previously had other claims discontinued) or is it the same process as before. 
    • I know what I need to do in the event of Job but there is no assurance it will be quick... I think for my mental health ill just do the Income and expenses and send the Pro rata letters to each creditor and take control this month and then I am taking control of my fate. Credit file in the end has only gotten me in trouble and more out of control.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

So far i am at the stage of waiting for the bank response to my request i have recieved a letter saying i shall be notified within 4 weeks which expires on march 3rd.

 

i requested my statements sending the cheque and recieved all without problem even getting my cheque returned with a note saying the abbey do not charge for this facility.

 

im eagerly reading all the links for information on how to respond to the expected abbey response. and how to combat barclays who i am also claiming from both banks total around £5000. barclays incidentally also sent statements no problem and also returned my £10 cheque

It's worth having a good read of the various posts on this site while you wait for the responses, then you'll be prepared for the next steps well in advance!

 

It seemed a scary prospect when I decided to try to get back what I'm owed, but here there are lots of people all in the same position, so it's much less scary and there's always someone else to ask!

cheers im actually pretty laid back about it but will admit to some nerves the closer i come to realising i will def have to go much further to get back my money.

 

think i will start on my credit cards soon do i just use the same letters changing the wording for overdraft charges etc for late fees?

Are you talking about the preliminary request for your money back? If so, DO NOT follow the bank's timetable, they will only delay evrything. follow the steps and timetable as advised on this site

You are lucky i had to pay a fee and it took nearly 5 months to get my statements!

Today i recieved my first offer from the abbey. usual thing from reading the posts a GOGW totalling 653 quid very nice indeed but around 1700 quid shy of what im claiming. so this week i think i shall send my lba off and see what comes of that!! fingers crossed

ok just checking before i print something off this weekened.

 

i have recieved a GOGW for £653 which is around 1700 short of what i am claiming should i write asking again for the full amount or just send off my letter before action. as i am now at a similiar stage with barclays so i can hit both of them at the same time!

right recieved 2 letters from the abbey today. one on headed one not. basically saying the same thing.

 

"sorry they havent resolved my compliant blah blah one of my team will look into it blah blah. will investigate further and get back in 4 weeks. "

 

well i gave them till the 19th to pay up or i will start court proceedings.

shall i bother calling them or just start proceedings now? cos they clearly are just stalling

ok i called them said the 19th was their time scale and they said they needed more. i said they had plenty and monday was it. but id happily discuss settlement with someone now. they said noone was free so i picked up my n1 forms today i think im gonna need em!

My boyfriend has just shown me this site giving me abit of hope. Dec 2005 Abbey charged me £210:o in one day for 7 direct debits that went out of my bank account before my wages had cleared! (not what you need before xmas) I HAVE NEVER BEEN OVERDRAWN & NEVER HAVE SINCE. AFTER LOTS OF VERY TEARFULL PHONE CALLS & DEALIING WITH ALOT OF UN HELPFULL PEOPLE ONE GIRL MANAGED TO DROP 3 OF THE £30 CHARGES still leaving me with £120 to pay. Ive been into my bank on numerous occasions but they just say point you to there phones & tell you to call them. Ill use these addresses to send out my letters wish me look! Any advise please let me know!
