      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Sent my LBA to lloyds - 14 days is up and i have had no response. do i send them another letter or proceed to the moneyclaim site to start court action.

How does the moneyclaim site work do they inform bank of what is happening - i was doing fine with this claim untill i got to this part now im losing the plot a bit.

All help greatly appreciated.

Hi just wondered if you have had a reply from LTSB yet - my 14 days was up yesterday (didnt realise that until today been soo busy!) and have had no response, so going to spent most of tomorrow trying to get my head around the MCOL system thing. (beats doing the housework i suppose!:eek: )

I'm only claiming a small amount and was hoping they would cough up as they have done others, but seems no such luck yet!

They don't seem to have responded to any LBA's sent from about the 3rd Feb onwards for some reason.

I'm waiting to hear also, although it's only been 7 days so far.

 

I sent the first letter, prelim letter, and in order to keep my ball rolling, I think it should be LBA next, if I'm correct, can someone give me a link to the LBA letter please.

 

When sending the LBA letter, do I send it recorded delivery, or just through the normal post?

iv had no response from lloyds at all .see my thread .

llo yds sem not to be replying to any letters and if you ring them their staff get irate and are most unhelpfull (nothing new there lol )

ive just went through with the claim same as last time and have filled in a money claim online

I had no reply to the LBA after the 14 days cut off date. So i went ahead and filled out court papers (i had not sent them just filled them out) when on the very same day i received a letter from lloyds offering my half the claim as a good will gesture. Money was in my account a few days from letter date. I replyed with a very nice thank you for your offer but due to you not repsonding within the 14 days stated in my letter all court papers have been issued and you should receive copies off these from the court soon.

So yes half has been put in my account but i am going for the whole lot.

Has anybody had their debit card taken off them since starting to claim back bank charges from Lloyds Tsb? I went into the bank today to ask why I can't use my debit card and was eventually told that they don't like the way I'm managing my account however they are happy for me to have a cash point card (really helpful!!). Strange as two weeks ago I started the reclaiming process. I haven't recieved any notification of their chosen action via post or telephone.

If they do that to me I'm afraid I would have seriously start thinking about closing my account and moving my money elsewhere (whilst continuing with my claim of course!) - seems they never stop thinking up vindictive little ways of trying to 'get their own back'!

Strange as two weeks ago I started the reclaiming process. I haven't recieved any notification of their chosen action via post or telephone.

 

I cannot recall anyone having this problem before, but i may be wrong as there are sooooo many threads.

 

I think that they owe you a better explanation than merely saying they are not happy with the way you are managing your account.

I went into the bank today to ask why I can't use my debit card and was eventually told that they don't like the way I'm managing my account however they are happy for me to have a cash point card (really helpful!!). Strange as two weeks ago I started the reclaiming process. I haven't recieved any notification of their chosen action via post or telephone.

 

I had mine taken off me many years ago for continued account miss-use i.e. i was getting charged several times a month. The loss of your card may therefore have nothing to do with reclaiming charges, all depends on what your conduct has been like

Surely, you would be able to ask the Financial Ombudsman to look into this?
