    • I agree with dx about the letter, please don't send that. I'll have a think about it later and I hope dx will have time to as well. Regarding you teaching undergrads, did you talk to your students union about how a criminal record would affect you?
    • sorry but that letter needs to be much much better. you need to express that it was a stilly youthful mistake trying to be the big man and jumping the turnstile to look big infront of your peers. TfL prosecutors are on the email address on their first letter. get the court form sent back to the court , (but copy it first) stating you plead guilty and wish to attend to address the judge in person face to face to show your genuine remorse for your stupid youthful exuberance.

I hope that I could teach the lovely students again, which may not be allowed with a criminal record. I would please ask that you would please provide me a single opportunity to settle all outstanding sums owed outside of court without the need for legal proceedings which would have a determinantal impact on my teaching career.  I sincerely apologise again for my crime.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

How this for a quote from Collect2007 talks, Christ knows how bad the rest of these companies must be if Cabot can gain 1st and 2nd place!!!

Newsflash:

I read with interest that there's a possibility that Cabot may be using (or may be intending to use) 'Lie detection software' when on the phone to customers.. Check this report out on this link > Cautious tone on lie detector software - vnunet.com If you do ever speak to Cabot on the phone, make sure they know you're aware of the RIPA 2000

As per my other bit on another link: It 'appears' that Cabot are using, or intend to use, Lie Detection Software..If you look at slide 13 of Ken's recent presentation > Collect 2007 you'll see what I mean. If he is urging other DCA's to use this software then Cabot must already be using it or, as i said, intending to use it.

 

Time to brush up on the RIPA me thinks > Regulation of Investigatory Powers Act 2000

Bloody hell, I get up at some unearthly time in the morning to mosey about the forum and this is the first time I have ever found this thread on Cabot and it's already 80 odd posts long :o Why didn't someone tell me? Two things here pmhcfc, First is I owe the man an apology - I almost can't bring myself to do it, but being the principled old dear I am - here it comes:

 

1st) Mr Maynard I said you never give to Charity cos it says so in your accounts that £0 went to charity. So I take it back, Helen Rollason was a great gal. Good to see you doing some good for once. There's a few debt counselling charities that could also do with some, but I take this as a good start.

 

 

Not sure if they actually give anything themselves Andrew..The report says that the money is raised by STAFF buying raffle tickets etc. And a staff member's husband running the marathon, donations are from STAFF, family and friends. Also, money is raised through the Xmas raffle..Tickets bought by STAFF. I've worked for companies a lot bigger than Cabot and the Xmas raffle prizes are normally donated by other companies and local business. But you're right that Helen was a great gal.

 

And, as a footnote, not that I'm suspicious of the antics of Cabot, but it's a strange coincidence that the guy who ran the marathon is the husband of the lady who was nominated (working for Cabot) for a Business of the Year award 2007...Of course it has nothing to do with earning Brownie Points for the said member of staff who was up for the award...

Cheeky feckers don't even answer the phone with "Hello FIRE, how can I help" .. They just ask you for your reference number immediately.. Hmmm, if they are registered as dormant, and they have no staff working for them, how can they answer the phone number given to call them ?

 

Does this need reporting to companies house ?
