Spoke to Krysta earlier today. Most interesting conversation.

 

1 - She had just received back confirmation of my charges, so they do check them.

 

2 - She will settle the case at the figure as my claim, to which I replied that was the figure. She then said do you have an up to date calculation? Give me the figure up to your court date, which I did. This she accepted.

 

3 - Letter out this afternoon tomorrow at lastest, she is very busy!

 

So looks like it is nearing the end. Have spent this evening calulating my costs so I can submit a wasted court order request when I write to the court and confirm settlement. But only after the cheque has cleared!

Hello All,

Just finished my MCOL with Barclays for £5,000. Heres hoping I have the same success as many have had from this site. If I win will def. donate some dosh to this site. I am just getting a little nervous now it has all got this far, it seems like this is the last step, just hope I dont have to go to court, I mean who will run the Krusty Krab???????

Got my letter today. Crossed out confidentiality. Changed "full and final settlement of your claim" to "full and final settlement of this claim". And finally crossed out paid into Barclays account and made it a cheque. Added letter saying will write to court when funds have cleared and faxed it all back to Krysta.

Hey it got a reply. Have received a General Form form the court. Following claimant applying for costs arising form defendant's unreasonable conduct, etc.

 

The defendant shall serve comments, objections or otherwise within 14 days. The court shall consider therafter, in the absence of both parties, assessment of costs.

Yes but it is a little hit and miss. Northampton refused last week against Intelligent Finance. But I think Northampton may be so busy they just want shot of cases as quickly as possible!
